Decree 170 on guidelines for organizing urban government in Da Nang from January 1, 2025
On December 27, 2024, the Government of Vietnam issued Decree 170/2024/ND-CP stipulating the organization of urban government, specifically regarding the organizational activities of the District People's Committee and the responsibilities of the Chairman of the District People's Committee; the organizational activities of the Ward People's Committee and the responsibilities of the Chairman of the Ward People's Committee; election, recruitment, management, and use of officials working at the District People's Committee and officials working at wards and communes; drafting, implementing, and settling the budget of districts and wards in Da Nang City (hereinafter referred to as the city).
Decree 170/2024/ND-CP applies to the following entities:
- District People's Committees, Ward People's Committees; officials working at the District People's Committees; officials working at wards and communes of the city.
- Related agencies, organizations, and individuals.
Decree 170/2024/ND-CP takes effect from January 1, 2025, simultaneously replacing Decree 34/2021/ND-CP, which prescribes detailed provisions and implementation measures of Resolution No. 119/2020/QH14 dated June 19, 2020, of the National Assembly regarding the pilot organization of the urban government model and some specific mechanisms and policies for the development of Da Nang City, to the extent that it loses validity from the effective date of this Decree.

What is the organizational structure of the District People's Committee of Da Nang City?
Pursuant to Article 3 of Decree 170/2024/ND-CP on the organizational structure of the District People's Committee:
Article 3. Organizational Structure of the District People's Committee
The organizational structure of the District People's Committee is implemented according to the provisions of Clause 1, Article 7 of Resolution No. 136/2024/QH15.
Pursuant to Clause 1, Article 7 of Resolution 136/2024/QH15 on the organizational structure, working policies, duties, and powers of the District People's Committee:
Article 7. Organizational Structure, Working Policies, Duties, and Powers of the District People's Committee
- The organizational structure of the District People's Committee includes the Chairman of the District People's Committee; Vice Chairmen of the District People's Committee; Commanding Officer of the District Military Command; Chief of District Police; specialized agencies under the District People's Committee; other administrative agencies and public service providers under the District People's Committee. District People's Committees of type I have no more than 03 Vice Chairmen, and type II have no more than 02 Vice Chairmen.
The Chairman of the District People's Committee and the Vice Chairmen of the District People's Committee are officials holding leadership and management positions within the District People's Committee.

The organizational structure of the District People's Committee in Da Nang City includes:
- Chairman of the District People's Committee
- Vice Chairmen of the District People's Committee
- Commanding Officer of the District Military Command
- Chief of District Police
- Specialized agencies under the District People's Committee
- Other administrative agencies and public service providers under the District People's Committee, with type 1 districts having no more than 03 Vice Chairmen and type 2 districts having no more than 02 Vice Chairmen.
Who shall promulgate the working regulations of the District People's Committee in Vietnam?
Pursuant to Article 5 of Decree 170/2024/ND-CP on the responsibilities of the Chairman of the District People's Committee:
Article 5. Responsibilities of the Chairman of the District People's Committee
- The Chairman of the District People's Committee is responsible for implementing the provisions of the Law on Cadres and Officials, Resolution No. 136/2024/QH15, other relevant legal provisions, and adhering to the Working Regulations of the District People's Committee, as well as the following responsibilities:
a) Issuing the Working Regulations of the District People's Committee;
b) Leading and directing the activities of the District People's Committee, specialized agencies, and public service providers directly under the District People's Committee;
c) Managing officials and public employees working in districts and wards in accordance with the law on management of officials and public employees and according to the delegation and authorization of the City People's Committee and the Chairman of the City People's Committee;
d) Signing documents of the District People's Committee in the capacity of the Chairman of the District People's Committee, the head of the state administrative agency in the district, and bearing responsibility for documents of the District People's Committee;
dd) Suspending the implementation, annulling part or all unlawful documents of specialized agencies under the District People's Committee and unlawful documents of Ward People's Committees.
- The Chairman of the District People's Committee who violates their responsibilities prescribed under this Article shall be considered for handling according to the Law on Cadres and Officials and other relevant legal provisions.
The Chairman of the District People's Committee is responsible for issuing the Working Regulations of the District People's Committee.
