Decree 154/2024/ND-CP detailing the provisions and implementation measures of the Law on Residence in Vietnam
On November 26, 2024, the Government of Vietnam issued Decree 154/2024/ND-CP detailing a number of articles and measures for the implementation of the Law on Residence regarding following issues:
- The residence of people living, people with mobile occupations on ships, boats, or other vehicles capable of moving.
- The residence of people without permanent residence, temporary residence.
- Types of documents, materials proving legal residence, documents, materials proving personal relationships.
- Residence registration for minors; certain contents of residence registration and management.
- Dossier and procedure for deletion of permanent residence registration.
- Dossier and procedure for deletion of temporary residence registration.
- Information in the Database on residence, the construction and management of the Residence Database, and the collection, updating, adjustment, management, connection, sharing, and exploitation of information in the Residence Database.
Decree 154/2024/ND-CP applies to agencies, organizations, and Vietnamese citizens within the territory of the Socialist Republic of Vietnam.
Decree 154/2024/ND-CP takes effect from January 10, 2025

What information is included in the citizen residence database in Vietnam?
According to Article 11 of Decree 154/2024/ND-CP, the information in the citizen residence database includes:

Information in the Citizen Residence Database includes:
- Residence file number.
- Information prescribed in clauses 1 to 15, clauses 21 to 25 of Article 9 and clause 4 of Article 15 of the Law on Identity.
- Other names.
- Permanent residence, time of commencing permanent residence; reason, time of deleting permanent residence registration.
- Temporary residence, time of commencing temporary residence, duration of temporary residence; reason, time of deleting temporary residence registration.
- Status of temporary absence declaration, subjects of temporary absence declaration, duration of temporary absence, destination during temporary absence, end time of temporary absence.
- Current place of residence, time of commencing current residence.
- Lodging place, duration of lodging

Thus, the Citizen Residence Database contains the following information:
- Residence file number.
- Given name, middle name, and birth name.
- Other names.
- Personal identification number.
- Date of birth.
- Gender.
- Place of birth.
- Place of birth registration.
- Hometown.
- Ethnicity.
- Religion.
- Nationality.
- Blood type.
- 09-digit identity card number.
- Date of issue, place of issue, expiration date of the identity card, citizen identification card, 12-digit identity card issued.
- Given name, middle name, and name, personal identification number, 09-digit identity card number, nationality of father, mother, spouse, children, legal representative, represented person.
- Marital status.
- Relationship to the household head.
- Given name, middle name, and name, personal identification number, 09-digit identity card number of the household head and family members.
- Date of death or missing.
- Mobile phone number, email address.
- Occupation, except for members of the People's Army, People's Public Security, Cryptographic forces.
- Other names.
- Permanent residence, time of commencing permanent residence; reason, time of deleting permanent residence registration.
- Temporary residence, time of commencing temporary residence, duration of temporary residence; reason, time of deleting temporary residence registration.
- Status of temporary absence declaration, subjects of temporary absence declaration, duration of temporary absence, destination during temporary absence, end time of temporary absence.
- Current place of residence, time of commencing current residence.
- Lodging place, duration of lodging.
- Criminal record.
- Administrative record.
- Preventive measures applied.
- Record expungement.
- Number, name of agency, authority issuing, date, month, year of issuing documents on granting Vietnamese nationality, renunciation of Vietnamese nationality, revocation of Vietnamese nationality, annulment of decision on granting Vietnamese nationality.
- Number, date, month, year, decision-making agency for wanted notices, searching, delay or annulment of wanted notices.
- Other citizen information integrated and shared from other databases.
What are cases of restriction of citizens’ freedom of residence rights in Vietnam?
According to clause 2 of Article 4 of Law on Residence 2020, the exercise of citizens' freedom of residence rights is restricted in the following cases:
- Persons prohibited from leaving their residence by authorities, subject to custody or temporary detention.
- Persons sentenced to imprisonment but without enforcement decision or having enforcement decision but on probation or with suspended sentence enforcement.
- Persons sentenced to imprisonment with suspended sentence under probation period.
- Persons serving imprisonment, prohibited residence, probation, or non-custodial reform sentences.
- Persons granted early conditional release on probation period.
- Persons undergoing education at commune, ward, commune-level town, compulsory education facilities, compulsory rehabilitation facilities, or reform schools.
- Persons required to serve measures at compulsory education facilities, compulsory rehabilitation facilities, reform schools but deferred or temporarily suspended enforcement.
- Persons under supervision during procedures for considering and deciding on applying compulsory measures.
- Persons quarantined due to risk of infectious disease spread to the community.
- Quarantine locations, areas due to infectious disease prevention and control as decided by authority or areas under emergency status as per law; locations not eligible for new permanent or temporary residence registration or household division as prescribed.
- Other cases as prescribed by law.
