Can a Communist Party Member with a Reprimand Disciplinary Decision Be Appointed to the Party Committee Personnel?
Section 3, Article 40 of the Charter of the Communist Party of Vietnam 2011 stipulates:
Party members disciplined by removal from office, within one year from the date of decision, are not to be elected into the Party Committee, nor appointed to equivalent or higher positions.
Furthermore, according to Article 40, Section II of Regulation 30-QD/TW in 2016:
- Party members disciplined by removal from office, including positions elected by congress, the Party Committee, the inspection committee, or those appointed/designated, within one year from the date of announcement of the decision, are not to be elected into the Party Committee, nor designated or appointed to equivalent or higher positions.
- After one year from the date of the announcement of the disciplinary decision or the decision on resolving a disciplinary complaint (except for expulsion decisions), if the Party member does not file a complaint, does not relapse, or has no new violations warranting disciplinary action, the disciplinary decision shall naturally cease to be effective.
Thus, in the case where a Party member has been disciplined by reprimand, they are still eligible to be elected to the Party Committee. Only when a Party member is disciplined by removal from office, within one year from the date of the decision, are they not to be elected into the Party Committee, nor appointed to equivalent or higher positions.
