Are civil servants allowed to pay for meals when participating in refresher training in Vietnam? Can civil servants who have failed to complete their duties for 2 non-consecutive years be reappointed in Vietnam? What is content and form of recruitment for commune-level civil servants in Vietnam?

Hello. I am currently a civil servant working at a commune unit. I recently received the decision to participate in centralized training. I have a question: When I attend this training, will I be paid for meals?

Are civil servants allowed to pay for meals when participating in refresher training in Vietnam?

At Point c, Clause 3, Article 4, Circular 36/2018/TT-BTC has the following regulations:

c) Expenditure made by entities sending officials and public employees to training centers: heads of entities sending officials and public employees shall utilize concurrent expenditure and other funding sources of their own to pay for:

- Partial expenditure on allowance during study trip;

- Commuting expenses from the agencies to places of study (one trip to and from; holiday; Tet break);

- Rental of accommodations for learners during study trips at training centers (if any);

- Support for officials and public employees who are female or ethnics according to regulations and law on gender equality and ethnic minority work.

Entities sending officials and public employees to train shall not cover commuting expenses and accommodation expenses in case of commune-level part-time workers; part-time workers in communes, villages, neighborhoods, wards and townlets that are supported by training centers or entities assigned to of

According to this Article, when participating in refresher training during your study period, you will receive a partial of your food allowance in Vietnam.

Can civil servants who have failed to complete their duties for 2 non-consecutive years be reappointed in Vietnam? 

According to Clause 1, Article 29, Decree 112/2011/ND-CP stipulates as follows:

1. Commune-level civil servants are entitled to severance benefits in the following cases:

a) As desired and approved by the District People's Committee;

b) Due to 02 consecutive years of not completing tasks as prescribed in Clause 3, Article 58 of the Law on Cadres and Civil Servants;

c) Commune-level Military Commanders, Commune Police Chiefs, other than the cases specified in Points a and b, Clause 1 of this Article, when being disciplined in the form of demotion or dismissal without arrangement. If he/she hold another civil servant position at the commune level, he/she will also be entitled to a severance regime within 30 days from the effective date of the disciplinary decision.

In Clause 12, Article 1 of the Law on Cadres, Civil Servants and the Amended Law on Public Employees 2019, there are provisions as follows:

Article 58. Ranking of civil servant quality

1. Based on the assessment results, civil servants are graded in quality according to the following levels:

a) Complete the task excellently;

b) Complete the task well;

c) Complete the task;

d) Fail to complete the task.

2. The results of civil servant quality classification are saved in civil servant records, notified to evaluated civil servants and publicly announced in the agencies, organizations and units where civil servants work.

3. Handling of civil servants who fail to complete their tasks is prescribed as follows:

a) Agencies, organizations, and units have the authority to dismiss civil servants whose quality has been rated at the level of not completing their tasks for 2 consecutive years;

b) Civil servants holding leadership or management positions for 02 non-consecutive years within the appointment term are classified as having failed to complete their tasks, so they will be assigned to another job or not re-appointed;

c) Civil servants who have not held a leadership or management position for 03 years with 02 non-consecutive years are classified as having not fulfilled the duties of their current job position, then they will be placed in jobs with lower requirements..

Thus, leading civil servants who have 02 non-consecutive years within the appointment period and are classified as not having completed their duties will not be reappointed in Vietnam.

What is content and form of recruitment for commune-level civil servants in Vietnam?

Pursuant to Clause 6, Article 1 of Decree 34/2019/ND-CP has the following regulations:

Article 14. Content and form of admission

1. For the positions of Office - statistics, Cadastre - construction - Urban and environment (for wards and towns) or Cadastre - agriculture - construction and environment (for communes), Finance - accounting, Justice - civil status, Culture - society, admission is carried out in 2 rounds as follows:

a) Round 1:

Check the candidate's diplomas, certificates, academic results, and priority subjects according to the requirements of the civil servant title registered in the application form. If suitable, the candidate can participate in the round. 2 provisions in point b of this clause;

No later than 05 working days after the end of checking the conditions and standards of candidates in round 1, the Chairman of the District People's Committee must notify the summoning of qualified candidates to attend round 2;

No later than 15 days after the date of notice calling candidates to participate in round 2, an interview must be held.

b) Round 2: Interview to test the candidate's capacity and professional qualifications. Interview scores are calculated on a scale of 100. Interview time is 30 minutes. There is no review of the interview results.

2. For the positions of Commune-level Military Commander and Commune Police Chief, consider the recruitment registration conditions as prescribed in Clause 2, Article 6 of this Decree; For communes and towns where regular police are arranged, it shall comply with the provisions of the Law on People's Public Security.

With this regulation in Vietnam, depending on the positions, the content and form of recruitment for commune-level civil servants will comply with the above regulations.
