Which types of land have a long-term stable land use term from January 1, 2025 in Vietnam?
Pursuant to Article 171 of the Land Law 2024, the types of land with a long-term stable use period from July 1, 2025, include:
[1] Residential land
[2] Agricultural land used by the community:
- The community is allocated land by the State, recognized land use rights to preserve the cultural identity associated with customs, practices, and beliefs of ethnic groups;
- The community is allocated land, recognized land use rights with the responsibility to protect the allocated land, not to be used for other purposes.
[3] Special-use forest land; protective forest land; production forest land managed by organizations.
[4] Commercial land, service land, non-agricultural production base land used stably by individuals recognized by the State, not land allocated by the State with a time limit, for lease.
[5] Land for construction of headquarters of the following organizations:
- Communist Party of Vietnam;
- State agencies;
- Vietnam Fatherland Front;
- Political-social organizations;
- Political-social-professional organizations;
- Social-professional organizations;
- Social organizations;
- Other organizations established under the provisions of the law and assigned tasks, supported with regular operating funds by the State.
[6] Land for construction of works of Public service units
- Land for construction of cultural, social, health, education and training, physical education and sports, science and technology, environment, meteorology, diplomacy, and other public career works;
- Land for construction of headquarters of other Public service units;
[7] Defense and security land
[8] Religious land
[9] Worship land
[10] Land used for non-profit public purposes.
[11] Cemetery land, funeral home, crematorium; land for preserving ashes
[12] Cases of changing the purpose of use from non-agricultural land with long-term stable use to non-agricultural land with a time limit or from non-agricultural land with a time limit to non-agricultural land with long-term stable use.
[13] Cases of receiving the transfer of land use rights for types of land with long-term stable use.

Which cases does the State lease land and collect an annual land rental in Vietnam?
Pursuant to Clause 3 of Article 120 of the Land Law 2024, the land lease regulations are as follows:

3. The State leases land and collects an annual land rental in the following cases:
a) Cases not covered by the provisions of this Clause 2;
b) Cases covered by the provisions of this Clause 2 but have a need to pay an annual land rental;
c) Public service units choose the form of land lease as prescribed in Clause 3 of Article 30 of this Law.
Therefore, the state leases land and collects an annual land rental in the following cases:
- Cases not covered by the following cases:
+ Using land to implement agricultural, forestry, aquaculture, and salt-making investment projects;
+ Using land for industrial zones, industrial clusters, high-tech zones, workers' accommodation in industrial zones; land used for non-profit public purposes with business purposes; using land for commercial and service purposes for tourism activities, office business;
+ Using land to build social housing for rent as prescribed by the law on housing.
- Cases where the state leases land and collects one-time land rent for the entire lease period but have a need to pay an annual land rental;
- Public service units choose the form of land lease as prescribed.
What principles are land use based on in Vietnam?
Pursuant to Article 5 of the Land Law 2024, land use is based on the following principles:
- Compliance with land for the intended purpose.
- Sustainable, efficient, and economical use of land and surface and subsurface resources.
- Protection of land, protection of the environment, adaptation of climate change, there is no abusing plant protection drugs, chemical fertilizers causing pollution, land degradation.
- Implementation of the rights and obligations of land users within the land use period as prescribed by this Law and other relevant laws; no infringement upon the legitimate rights and interests of adjacent and surround of land users.
Note: The Land Law 2024 takes effect from January 1, 2025. Article 190 and Article 248 of the Land Law 2024 take effect from April 1, 2024.
