1. Preparation for contractor selection, including:

a) Shortlist selection (if necessary);

b) Prepare bidding documents;

c) Evaluation and approval of bidding documents.

2. Organize contractor selection, including:

a) Bidding invitation;

b) Issuing, amending and clarifying the bidding documents;

c) Prepare, submit, receive, manage, amend and withdraw bids;

c) Open technical proposals.

3. Evaluation of technical proposals, including:

a) Check and evaluate the validity of technical proposals;

b) Detailed evaluation of technical proposals;

c) Approve the list of contractors satisfying the technical requirements.

4. Opening and evaluating financial proposals, including:

a) Open the financial proposals of the contractors on the approved list;

b) Examine and evaluate the validity of financial proposals;

c) Detailed evaluation of financial proposals;

d) contractor ratings.

5. Contract negotiation.

6. Submit, appraise, approve and publicize contractor selection results.

7. Finalize and sign the contract.

What is selection of a short list of public bidding with packages of consulting service providers under the CPTPP Agreement in Vietnam?

Pursuant to Article 56 of Decree 95/2020/ND-CP stipulating selection of a short list of public bidding with packages of consulting service providers under the CPTPP Agreement, as follows:

Based on the size and nature of the bidding package, the short list selection procedure may be applied to select qualified and experienced contractors as required by the bidding package to invite to participate in the bidding. The application of the short list selection procedure is decided by the competent person and must be clearly stated in the contractor selection plan.

1. Shortlist selection steps:

a) Prepare a dossier of invitation for expression of interest:

- A dossier of invitation for expression of interest includes the following contents: Brief information about the project or bidding package; instructions on the preparation and submission of an expression of interest; standards on capacity and experience of contractors, which include requirements on the number, qualifications and experience of experts;

- Using the scoring method on a scale of 100 or 1,000 to develop criteria for evaluating dossiers of interest, in which the minimum required score must not be lower than 60% of the total score and the evaluation score of each individual. content about capacity, experience and personnel is not lower than 50% of the maximum score of that content;

b) The approval of the request for expression of interest must be in writing and based on the approval submission and report on the evaluation of the request for expression of interest;

c) Notice of invitation for expression of interest shall comply with the provisions of Point b, Clause 1, Clause 3, Article 9 and Clause 2, Article 10 of this Decree;

d) Issuance of dossiers of invitation for expression of interest:

Dossier of invitation for expression of interest shall be freely published on the National Procurement Network immediately after the successful posting of the notice of invitation for expression of interest;

dd) Receive and manage dossiers of interest:

- In case the bid solicitor receives the dossier of expression of interest not online:

The bid solicitor receives and manages the submitted dossiers of expression of interest according to the regime of confidential records management until the results of the invitation for expression of interest are made public;

- In case the bid solicitor receives the dossier of expression of interest online:

The national procurement network system notifies bidders of the status of their application of interest (successful or unsuccessful). The national bidding network system will record the following information about the tenderer's submission of the dossier of expression of interest: information about the sender, the receiver, the time of submission, the sending status, the number of attached files to the System. national bidding network system;

e) Open dossier of interest:

- In case the bid solicitor receives the dossier of expression of interest not online:

Bids submitted at the time and place specified in the request for expression of interest will be opened immediately after the bid closing time. The opening of dossiers of expression of interest must be recorded in writing and the minutes of bid opening shall be sent to bidders submitting their expression of interest. Bids submitted after the bid closing time will not be opened, will not be valid and will be rejected;

- In case the bid solicitor receives the dossier of expression of interest online:

The bid solicitor opens the dossier of expression of interest on the national bidding network right after the bid closing time. Minutes of EOI opening shall be publicly posted on the national bidding network system within 02 hours from the time of bid closing;

g) Evaluation of dossiers of interest:

The evaluation of dossiers of expression of interest shall comply with the evaluation criteria specified in the request for expression of interest. Bidders of interest with an assessed score of not less than the minimum required score are shortlisted; the bidder's expression of interest with the highest score is ranked first; in case there are more than 06 qualified contractors, the 06 highest ranked bidders shall be selected on the short list;

h) Submit, appraise and approve the results of invitation for expression of interest:

- On the basis of the report on the results of the evaluation of dossiers of expression of interest, the bid solicitor shall submit the results of the invitation for expression of interest, clearly stating the opinions of the bid solicitor on the evaluation contents of the expert group;

- Results of invitation for expression of interest must be verified before approval;

- The results of invitation for expression of interest must be approved in writing and based on the report on approval, the report on evaluation of the results of the invitation for expression of interest;

- In case the short list is selected, the written approval of the results of invitation for expression of interest must include the names of the contractors selected on the short list and the contents to be noted (if any). In case the short list cannot be selected, the written approval of the results of invitation for expression of interest must clearly state the reason for the failure to select the short list;

i) Publicize the short list: The short list must be posted according to the provisions of Point d Clause 1 and Clause 3 Article 9 of this Decree and sent notices to the bidders submitting their dossiers of interest.

2. Shortlisted contractors may not enter into a joint venture to participate in the bid.
