In Clause 1, Clause 2, Clause 3, Clause 4 Article 74 of Decree 95/2020/ND-CP stipulates preparation for bidding at second stage, accordingly:

1. Prepare bidding documents for second stage:

a) Basis for preparing bidding documents:

In addition to the grounds specified in Clause 1, Article 37 of this Decree, when preparing bidding documents for the second stage, it must be based on the minutes of exchange between the bidding party and contractors participating in stage one bidding;

b) Contents of bidding documents:

The bidding documents for second stage are prepared on the basis of the bidding documents for stage one, in accordance with the technical corrections discussed with contractors.

2. Appraisal and approval of bidding documents:

a) Bidding documents must be appraised before approval and appraisal will only be conducted on contents related to technical adjustments compared to stage one bidding documents;

b) Approval of bidding documents must be in writing and based on the approval report and appraisal report of bidding documents.

3, Release, amend and clarify bidding documents:

The bidding party invites contractors who meet the technical requirements in stage one to receive bidding documents for second stage. The issuance, amendment and clarification of bidding documents for the second phase shall comply with the provisions of Clause 2, Article 38 of this Decree.

4. Prepare, submit, receive, manage, amend and withdraw bids:

The preparation, submission, receipt, management, amendment, and withdrawal of bids shall comply with the provisions of Clause 3, Article 38 of this Decree. The bid documents include technical proposals and financial proposals according to the requirements of the second stage bidding documents corresponding to the technical correction content.

What is bid opening at second stage of two-stage two-envelope procedure of procurement for bidding packages under the CPTPP Agreement in Vietnam?

According to Clause 5, Article 74 of Decree 95/2020/ND-CP regulating evaluation of bid dossiers and contract negotiation in second stage of two-stage two-envelope procedure of procurement for bidding packages under the CPTPP Agreement, accordingly:

a) The bid opening must be conducted publicly and begin within 01 hour from the time of bid closing. Only open bids that the bid solicitor receives before the bid closing time according to the requirements of the bidding documents in the presence of representatives of contractors attending the bid opening ceremony, regardless of the presence or absence of contractors;

b) The bid opening is carried out for each bid in alphabetical order by the bidder's name and in the following order:

- Check the seal of the bag containing the financial proposals in stage one, the financial proposals in stage one of the contractors participating in the second phase, and the bids of the contractors. Bidders participating in second stage bidding;

- Open financial proposals in stage one of contractors participating in second stage bidding and open bid documents in second stage including technical proposals and financial proposals according to the requirements of the bidding documents. Bidding documents for second stage correspond to technical corrections;

c) Bid opening minutes: The information mentioned in Point b of this Clause must be recorded in the bid opening minutes. The bid opening record must be signed by representatives of the bidding party and the bidders attending the bid opening. This record must be sent to contractors participating in second stage bidding;

d) The representative of the bidding party must sign to confirm the original bid forms, discount letters (if any), and power of attorney of the contractor's legal representative (if any); bid guarantee; financial proposals and other important contents of each bid.

What is evaluation of bid dossiers and contract negotiation in second stage of two-stage two-envelope procedure of procurement for bidding packages under the CPTPP Agreement in Vietnam?

Pursuant to Article 75 of Decree 95/2020/ND-CP regulating bid evaluation and contract negotiation in second stage:

1. Evaluation of bid dossiers and negotiation of second stage contracts shall be carried out in accordance with the provisions of Article 42 and Article 43 of this Decree; Do not re-evaluate the technical contents agreed upon in stage one.

2. Contractors that meet the technical requirements in second stage will be considered for financial evaluation. The financial assessment is carried out on the basis of the contractor's financial proposal in stage one and the financial proposal in second stage; Based on the contractor's technical proposals in stage one and the contractor's technical proposals for correction in second stage.
