What is approval of winning bids for bidding to provide procurement consulting services under the CPTPP Agreement in Vietnam?
In Article 34 of Decree 95/2020/ND-CP regulates the approval of winning bids for bidding to provide consulting services question:
1. Consulting contractors are organizations that are considered and recommended for winning the bid when they fully meet the following conditions:
a) Have valid bidding documents and proposal documents;
b) Have technical proposals that meet the requirements;
c) Have the lowest bid price after error correction, deviation adjustment, minus discount value (if any) according to the lowest price method; Have the highest technical scores for the fixed price method and the technical-based method; Have the highest composite score for the combined technical and price approach;
d) Have the winning bid price not exceeding the approved bid package price. In case the approved bidding package estimate is lower or higher than the approved bidding package price, this estimate will replace the bidding package price as the basis for approving the winning bid.
2. Consulting contractors are individuals who are considered and recommended for winning the bid when they fully meet the following conditions:
a) Have the best scientific background and technical proposals (if any) and meet the requirements of the terms of reference;
b) Have the winning bid price not exceeding the approved bid package price. In case the approved bidding package estimate is lower or higher than the approved bidding package price, this estimate will replace the bidding package price as the basis for approving the winning bid.

According to Article 35 of Decree 95/2020/ND-CP regulations on approval of winning bids for bidding to provide non-public services consulting, construction services, procurement of goods and mixtures, specifically as follows:
Contractors providing non-consulting services, construction services, goods procurement, and mixed services will be considered and proposed to win the bid when they fully meet the following conditions:
1. Have valid bidding documents and proposal documents;
2. Have the capacity and experience to meet the requirements;
3. Have technical proposals that meet the requirements;
4. Have arithmetic errors with total absolute value not exceeding 30% of the bid price;
5. Have a deviation of no more than 10% of the bid price;
6. Have the lowest bid price after error correction, deviation adjustment, minus discount value (if any) for the lowest price method; has the lowest evaluated price according to the evaluated price method; has the highest composite score for the combined technical and price approach;
7. Have a winning bid price that does not exceed the approved bid package price. In case the approved bidding package estimate is lower or higher than the approved bidding package price, this estimate will replace the bidding package price as the basis for approving the winning bid.
What is detailed single-stage two-envelope bidding procedure for procurement under the CPTPP Agreement in Vietnam?
Pursuant Article 36 of Decree 95/2020/ND-CP stipulates a detailed process of single-stage two-envelope bidding on procurement under the CPTPP Agreement, accordingly:
1. Prepare to select a contractor, including:
a) Prepare bidding documents;
b) Appraisal and approval of bidding documents.
2. Organize contractor selection, including:
a) Invitation to bid;
b) Issue, amend and clarify bidding documents;
c) Prepare, submit, receive, manage, modify and withdraw bids;
d) Bid opening.
3. Evaluation of bid documents, including:
a) Check and evaluate the validity of bid documents;
b) Detailed evaluation of bid documents;
c) contractor ranking.
4. Contract negotiation.
5. Submit, appraise, approve and publicize contractor selection results.
6. Finalize and sign the contract.
