What are regulations on payment for the type of procurement contract by time under the CPTPP agreement in Vietnam?

Based on Article 95 of Decree 95/2020/ND-CP, the regulations on payment for the type of procurement contract by time under the CPTPP agreement in Vietnam are as follows:

1. Principles of payment:

a) The remuneration for the expert is calculated by multiplying the expert's salary and the related costs to the salary, such as social insurance, health insurance, unemployment insurance, leave, holidays, and other costs stated in the contract or adjusted in accordance with the regulations, by the actual working time (in months, weeks, days, hours). In the event that the actual working time of the expert is less than or more than the time in the signed contract, the payment shall be based on the actual working time that the expert has performed.

b) The related costs (other than the expert's salary stipulated in Clause 1 of this Article) include: Management costs of the unit managing and using the expert (if any); travel costs, surveys, office rental, communication, and other costs shall be paid according to the method specified in the contract. For each of these costs, the contract must clearly specify the payment method, such as payment based on actual costs based on invoices and valid documents issued by the contractor or payment based on the agreed unit price in the contract.

2. Payment documents:

Depending on the nature of the consulting work, the payment documents are specified accordingly, such as the minutes of the acceptance of the results of the consulting work, documents confirming the progress of the contract implementation, and other related documents and certificates.

Based on Article 95 of Decree 95/2020/ND-CP, the regulations on liquidation of procurement contracts under the CPTPP agreement in Vietnam are as follows:

1. Cases of liquidation of procurement contracts:

a) The contract is liquidated when the parties have fulfilled their obligations under the signed contract.

b) The contract is terminated (cancelled) in accordance with the provisions of law.

2. Liquidation of procurement contracts:

The liquidation of procurement contracts must be recorded in a minutes and signed by the parties to the contract. The minutes of liquidation of procurement contracts may be prepared separately or as part of the minutes of the final acceptance or minutes of the agreement to terminate the contract with the content consistent with the responsibilities of the parties as specified in the contract and the contract will be considered to have been liquidated within 45 days from the date the parties to the contract complete the responsibilities in the minutes of liquidation of procurement contracts mentioned above; for contracts with large and complex scales, the liquidation of procurement contracts is carried out within 90 days.
