On September 11, 2024, the Government of Vietnam issued Decree 112/2024/ND-CP Download effective from September 11, 2024, detailing the following issues:

- High yield and quality rice cultivation planning areas

- Crop structure transformation, livestock, and construction of facilities directly serving agricultural production on rice cultivation land

- Protection and utilization of the topsoil of Arable rice cultivation land

- Payment for the state to supplement the area of Arable rice cultivation land lost or enhance the effectiveness of rice cultivation land use

- Support policies for local production, protection of rice cultivation land, and investment, and support policies for infrastructure construction, application of modern science and technology to high yield, and quality rice cultivation planning areas.

Clause 1 Article 3 of Decree 112/2024/ND-CP Download stipulates that "rice cultivation land" is land on which one or more rice crops are grown or rice is cultivated in combination with other legally permissible land uses where rice cultivation is primary. Rice cultivation land includes Arable rice cultivation land and remaining rice cultivation land. Specifically:

- Arable rice cultivation land is land on which at least two rice crops are grown per year.

- Remaining rice cultivation land is land on which one rice crop is grown per year and upland rice cultivation land.

What are the contents of the plan for using the topsoil when constructing projects on land that has been repurposed from rice cultivation land to non-agricultural land in Vietnam?

According to Article 10 of Decree 112/2024/ND-CP Download, the regulations on stripping and using the topsoil when constructing projects onland that has been repurposed from rice cultivation land to non-agricultural land are stipulated as follows:

Article 10. Regulations on stripping and using the topsoil when constructing projects onland that has been repurposed from rice cultivation land to non-agricultural land

1. Individuals allocated or leased land by the state when constructing projects on land converted from Arable rice cultivation land to non-agricultural land must have a plan for using the topsoil approved by the competent state authority.

2. The contents of the topsoil use plan include:

a) Information of the individual allocated or leased land requesting the conversion of Arable rice cultivation land;

b) Information about the area of Arable rice cultivation land requested for conversion;

c) The volume of the topsoil after stripping;

d) The plan, location, and purpose of using the stripped topsoil.

- Information of the individual allocated or leased land requesting the conversion of Arable rice cultivation land

- Information about the area of Arable rice cultivation land requested for conversion

What documents are included in the application for appraising the topsoil use plan in Vietnam?

According to Article 11 of Decree 112/2024/ND-CP Download, the regulations on the application and procedures for appraising the topsoil use plan in Vietnam are as follows:

Article 11. application, procedures for appraising the topsoil use plan

1. Individuals allocated or leased land by the state wishing to construct projects on land converted from Arable rice cultivation land to non-agricultural land shall submit a application to the District People's Committee or the Provincial People's Committee (for projects with Arable rice cultivation land area across two districts or more), the application includes:

a) Application for appraisal of the topsoil use plan according to the form in Appendix VII attached to this Decree;

b) The topsoil use plan according to the form in Appendix VIII attached to this Decree;

c) Diagram describing the position of using the stripped topsoil.
