Notice of Lost Land Use Rights Certificate: Is Posting Required by the Commune?
Clause 1, Article 77, Decree 43/2014/ND-CP stipulates the re-issuance of Certificates, Certificates of House Ownership, Certificates of Construction Ownership due to loss as follows:
Households and individuals, as well as community groups, must report the loss of their Certificate, Certificate of House Ownership, Certificate of Construction Ownership to the commune-level People's Committee where the land is located. The commune-level People's Committee is responsible for posting the notification of the lost Certificate at the office of the commune-level People's Committee, except in cases where the loss is due to natural disasters or fire.
Domestic organizations, religious establishments, foreign organizations, foreign individuals, and overseas Vietnamese must publish the loss of Certificate, Certificate of House Ownership, Certificate of Construction Ownership in the local mass media.
Therefore, after you report the loss of the land use right certificate, the commune-level People's Committee is responsible for posting the notification of the lost Certificate at the office of the People's Committee, except in cases where the paper is lost due to natural disasters or fire.
Therefore, in the case that you have reported the loss and after 2 months the commune has not posted the notification of the lost Certificate, it is considered a violation of legal regulations.
