What are conditions for granting a real estate brokerage certificate in Vietnam?
Let me ask you, I am a full-time university student majoring in Natural Resources Economics, National Economics University. If I take a course on real estate broker, will I be granted a real estate brokerage certificate?
Answer: According to Clause 4, Article 80 of the 2014 Real Estate Business Law, it is stipulated that the real estate brokerage certificate granted before the effective date of this Law shall stay unexpired for 05 years from its effective date; at the end of this period, the broker obtaining the certificate must meet requirements in this Law.
According to this regulation, currently those who want to operate in this field of brokerage must ensure the conditions to become a price appraiser according to the provisions of the law on prices. Specifically, according to Article 7 of Decree 89/2013/ND-CP stipulating the standards for price appraisers as follows:
1. Having civil act capacity.
2. Having ethical qualities, integrity, being honest and objective.
3. Graduated university, post-university specialized in price, appraisal of prices and sectors including: Economy, economy – technique, law involving operation of appraisal of prices issued by legal training organizations in Vietnam or other countries.
4. Having the actual working time under the trained specialties of from 36 (thirty six) months or longer, calculated from the date of issuing the university diploma of specialties specified in Clause 3 of this Article.
5. Having certificate of training on appraisal of prices issued by agencies, organizations which have function on training the appraisal of prices as prescribed by the Ministry of Finance, except from the following cases:
a) Persons who have had graduation diplomas of domestic or foreign universities or post-universities specialized in price, appraisal of prices;
b) Persons who have had graduation diplomas of domestic or foreign universities or post-universities specialized in economy, economy-technique, technique, law involving operation of appraisal of prices and had college diplomas specialized in appraisal of prices.
6. Possessing card of price appraiser issued by the Ministry of Finance.

I am 45 years old this year and want to apply for a real estate brokerage certificate? Is there an age limit for certification?
Answer: Clause 1, Article 68 of the 2014 Real Estate Business Law has the following provisions:
1. An individual shall be granted broker license if they:
a) Have full capacity for civil acts;
b) Obtain at least upper-secondary graduation degree;
c) Have passed examination in real estate brokerage knowledge.
This regulation does not set an age limit for obtaining a real estate brokerage certificate. So, if you are 45 years old and meet the 3 conditions mentioned above, you will be granted a real estate brokerage certificate in Vietnam.
Does managing a real estate trading floor need a broker license in Vietnam?
I plan to establish a real estate trading floor with some friends. It is expected that I will be the manager and operator of the floor, however I do not have a real estate brokerage practice certificate. Can I be a manager without a certificate? Thank you!
Answer: Pursuant to Article 69 of the 2014 Real Estate Business Law, requirements for real estate trading floor establishment include:
1. Any organizations or individuals who wish to provide real estate trading floor service must establish the enterprise.
2. The real estate trading floor enterprise must have at least 02 employees obtaining broker license; the manager of real estate trading floors must obtain a broker license.
3. A real estate trading floor must have regulations, name, address, facilities and technical satisfying requirements in terms of operation.
Thus, based on the above regulations in Vietnam, the manager of a real estate trading floor service enterprise must have a broker license. Therefore, if you do not have a broker license, you will not be able to manage or operate the floor in Vietnam.
