Who is required to participate in mandatory social insurance in Vietnam?
Based on Article 2 of the Social Insurance Law 2024, the subjects required to participate in mandatory social insurance and voluntary social insurance are defined as follows:
Article 2. Subjects Participating in Mandatory Social Insurance and Voluntary Social Insurance
- Vietnamese laborers subject to mandatory social insurance participation includes:
a) Employees employed under indefinite term labor contracts, definite term labor contracts with a term of at least one month, including cases where the employee and employer agree under other names but with contents relating to salaried work, wages, and the management, operation, supervision of one party;
b) Officials and public employees;
c) Employees and public employees of national defense, police employees, other employees in key organizations;

Thus, Vietnamese employees required to participate in mandatory social insurance include:
[1] Employees employed under indefinite term labor contracts, definite term labor contracts with a term of at least one month, including cases where the employee and employer agree under other names but with contents relating to salaried work, wages, and the management, operation, supervision of one party
[2] Officials and public employees
[3] Employees and public employees of national defense, police employees, other employees in key organizations
[4] Officers, professional soldiers of the people’s army; officers, technical non-commissioned officers of the police; employees in cipher enjoying salaries similar to soldiers
[5] Non-commissioned officers, soldiers of the people’s army; police non-commissioned officers on duty; military, police, cipher students entitled to living expenses
[6] Standing militiamen
[7] employees going to work overseas under contracts, except for cases of international treaties to which the Socialist Republic of Vietnam is a member with different provisions
[8] Spouses not earning a salary from the state budget sent to work on commission with members of the representative agency of the Socialist Republic of Vietnam abroad eligible for living expense policies
[9] Enterprise managers, controllers, representatives of state capital, representatives of enterprise capital under legal regulations; Board members, General Directors, Directors, members of the Supervisory Board or controllers, and other elected management positions of cooperatives, cooperative alliances enjoying salaries
[10] Non-specialized persons working at commune, village, residential groups
[11] Subjects [1] working part-time, with monthly wages equal to or higher than the salary used as the basis for the lowest mandatory social insurance contribution
[12] Business household heads of registered business households participating according to the Government of Vietnam's regulations
[13] Business managers, controllers, representatives of state capital, representatives of enterprise capital under legal regulations; Board members, General Directors, Directors, members of the Supervisory Board or controllers and other elected management positions of cooperatives, cooperative alliances not enjoying salaries.
Additionally, foreign employees working in Vietnam are required to participate in mandatory social insurance when working under a definite term labor contract with a term of at least 12 months with an employer in Vietnam, except for the following cases:
- Internal enterprise transfers as prescribed by Vietnam's regulations on foreign employees working in Vietnam
- At the time of signing the labor contract has reached the retirement age
- International treaties to which the Socialist Republic of Vietnam is a member with different provisions.
What are the acts of late payment for mandatory social insurance and unemployment insurance in Vietnam?
Based on Article 38 of the Social Insurance Law 2024, late payment for mandatory social insurance, unemployment insurance includes the following acts:
- Non-payment or insufficient payment of the amount payable according to registered mandatory social insurance participation files after the latest payment date
- Failing to register or partially registering the number of people required to participate in mandatory social insurance within the registration period for social insurance participation and issuance of social insurance books.
- Failing to register or partially registering the number of people required to participate in unemployment insurance within 60 days from the end of the mandatory unemployment insurance participation period as prescribed by the unemployment insurance law
- Belongs to cases not considered as evading mandatory social insurance, unemployment insurance contributions
