What is the support rate for career change of occupational victims when returning to work in Vietnam?

Pursuant to Article 55 of the Law on occupational safety and hygiene in 2015 stipulating support for career change of victims when returning to work:

Support for career change of victims when returning to work.

1. The employer shall assign new works for the victims as prescribed in Clause 8 Article 38 of this Law; the employee shall be supported tuition fees if the training courses for change in occupations are required.

2. The support does not exceed 50% of tuition fees and 15 times the statutory pay rate; each employee shall be entitled to up to 2 times of supports and once a year.

As regulated above, the support rate for career change of occupational victims when returning to work in Vietnam in 2024 is not more than 50% of the tuition fee and a maximum of not more than 15 times the statutory pay rate (the current statutory pay rate is 1,800,000 VND per month according to Decree 24/2023/ND-CP).

Note: The maximum number of support times for each employee is two. Within one year, they can only receive support once.

Pursuant to Article 12 of the Decree 88/2020/ND-CP stipulating conditions for receipt of assistance in career change for victims of occupational accidents and diseases upon their returning to work:

Conditions for receipt of assistance in career change for victims of occupational accidents and diseases upon their returning to work

An employer shall be provided with financial assistance in career change training for an employee as prescribed in Article 55 of the Law on Occupational Safety and Health if the employee satisfies the following conditions:

1. The employee suffers from WPI of at least 31% as a result of the occupational accident or occupational disease;

2. The employer offers the employee a new job under the management of the employer suitable for the employee’s health and expectation but the job requires vocational training before the change;

3. The employee is participating in occupational accident and occupational disease insurance in accordance with the law at the time of having the occupational accident or occupational disease.

As regulated above, an employer shall be provided with financial assistance in career change training for an employee if the employee satisfies the following conditions:

Pursuant to Article 14 of the Decree 88/2020/ND-CP stipulating the application for assistance in career change:

1. An application form for financial assistance in career change training for employees having occupational accident or disease, which is made using the Form No. 03 in the Appendix hereof.

2. A certified true copy of the WPI assessment report given by the Medical Examination Council.

3. Certified true copies of documents evidencing payment of tuition fees as prescribed.

As regulated above, the application for assistance in career change for employees having occupational accident in Vietnam includes following documents:

- An application form for financial assistance in career change training for employees having occupational accident or disease, which is made using the Form No. 03 in the Appendix hereof.

- A certified true copy of the WPI assessment report given by the Medical Examination Council.

- Certified true copies of documents evidencing payment of tuition fees as prescribed.
