Must Enterprises Pay Social Insurance for Elderly Workers Who Are Not Yet Eligible for Pension Benefits?
Pursuant to Clause 1, Article 2 of the 2014 Social Insurance Law, employees who sign a labor contract with a duration of one month or more are subject to mandatory social insurance participation.
And according to Clause 9, Article 123 of this Law:
Individuals receiving pensions, social insurance allowances, or monthly allowances who are also engaged in a labor contract are not subject to mandatory social insurance participation.
Thus, older workers who have not yet qualified to receive pensions are still subject to social insurance contributions if they sign a labor contract with a duration of one month or more.
