According to Article 25 of the 2014 Law on Social Insurance, the conditions for enjoying sick leave benefits are stipulated as follows:
- Employees must take leave due to sickness or non-occupational accidents and have certification from an authorized medical examination and treatment facility per the regulations of the Ministry of Health.
In cases where the employee must take leave due to sickness or accidents caused by self-harm, intoxication, or the use of narcotic substances or precursors as listed by the Government of Vietnam, they are not entitled to sick leave benefits.
2. Employees must take leave to care for their sick child under 07 years of age and have certification from an authorized medical examination and treatment facility.
Thus, in accordance with the above regulations, you will be entitled to sick leave benefits when taking leave to care for your sick 5-year-old daughter if you have a certification from hospital A.
How many days of sick leave are you entitled to when caring for a sick child?
According to Article 27 of the 2014 Law on Social Insurance, the duration of benefits when a child is sick is regulated as follows:
1. The duration of benefits when a child is sick within a year for each child is calculated based on the maximum number of care days: 20 working days if the child is under 03 years old; 15 working days if the child is between 03 years old and under 07 years old.
- If both the father and mother participate in social insurance, each parent is entitled to their own duration of benefits when caring for a sick child as specified in Clause 1 of this Article.
The leave period for sick child care as specified in this Article is calculated based on working days, excluding public holidays, Tet holidays, and weekly rest days.
Therefore, for your 5-year-old daughter, you will be entitled to a maximum of 15 days of sick leave per year to care for a sick child.
