Can a lump-sum social insurance withdrawal be authorized in Vietnam?

According to Article 109 of the 2014 Social Insurance Law stipulating dossier for enjoyment of lump-sum social insurance allowance as follows:

1. The social insurance book.

2. The employee’s application for enjoyment of lump-sum social insurance allowance.

3. For persons who settle abroad, a copy of the competent agency’s written certification of renunciation of Vietnamese nationality, or a certified or notarized Vietnamese translation of one of the following papers:

a/ Passport issued by a foreign country;

b/ Visa issued by a competent foreign agency, certifying such country’s permission for entry for overseas residence;

c/ Paper certifying such person is carrying out procedures for naturalization in a foreign country; paper certifying residence or permanent residence card or residence card of a term of 5 years or more, issued by a competent foreign agency.

4. Extract of the medical record, in the case specified at Point c, Clause 1, Article 60, or Point c, Clause 1, Article 77, of this Law.

5. For employees defined in Article 65, and Clause 5, Article 77, of this Law, a dossier for enjoyment of lump-sum social insurance allowance must comply with Clauses 2 and 3 of this Article.

Based on Article 138 of the 2015 Civil Code stipulating authorized representatives as follows:

1. Each natural or juridical person may authorize another natural or juridical person to enter into and perform a civil transaction.

2. Members of a household, co-operative group or a non-juridical person may agree to authorize another natural or juridical person to enter into and perform a civil transaction related to their common property.

3. A person aged from fifteen years to below eighteen years may be an authorized representative, except where the law provides for that the civil transaction must be entered into and performed by a person who has reached eighteen years of age.

Therefore, the law does not prohibit employees from authorizing others to withdraw lump-sum insurance, so you can authorize your mother to process the lump-sum insurance withdrawal for you. For cases of authorizing others to submit and receive lump-sum social insurance benefits, submit along with Form 13-HSB (Authorization Letter) attached to Decision 166/QD-BHXH 2019.

Clause 1, Article 1 of the Regulations on procedures for processing of applications for social insurance benefits and payment of social insurance and unemployment insurance benefits issued together with Decision 166/QD-BHXH 2019 stipulates the following lump-sum benefits:

- Lump-sum benefits include: Lump-sum benefits for occupational accidents and occupational diseases that result in deaths; payment for orthopaedic and rehabilitation devices; lump-sum pension; subsidies on funeral; subsidies for career change of workers who return to work after occupational accidents and occupational diseases; subsidies on provision of occupational disease examination or treatment; subsidies on work capacity restoration after occupational accidents and occupational diseases; medical assessment charges; seniority allowances for teachers upon retirements, etc.
