LawNet would like to introduce new and notable policies of Vietnam that have come into force in the beginning of June 2022 (June 11 - 20)

1. Uniform Adjustment for Market Management Agency Officials

On May 27, 2022, the Government of Vietnam issued Decree 33/2022/ND-CP providing guidelines for the Ordinance on Market Management. In particular, the market management outfit is granted to officials working at market management agencies at all levels, including:

- Men's shirts; (currently regulating spring-summer, and autumn-winter shirts in general for men)

- Women's shirts; (currently regulates spring-summer and autumn-winter shirts in general for women)

- Men's jackets; jackets for women;

- Overcoat, cotton shirt;

- Vests, windbreakers; (newly added)

- Men's casual pants; casual pants, skirts for women;

- Kepi hats (for men), soft hats (for women), cotton hats, ties;

- Other types of equipment include: belts; leather shoes; socks; helmets; and folders.

(Remove the group of ceremonial costumes, sandals, raincoats, boots, and workwear compared to current regulations.)

Market management clothing is issued to civil servants working at the market management agency in accordance with the target audience, job requirements, and geographical characteristics.

The Ministry of Industry and Trade of Vietnam shall decide or decentralize decisions on promulgating procurement regimes and procedures for the issuance of badges, ensigns, insignia, signboards, and market management clothing.

Decree 33/2022/ND-CP takes effect from July 15, 2022, replacing Decree 148/2016/ND-CP and Decree 78/2019/ND-CP.

2. Significant advancement in advanced accounting qualification standards

The Ministry of Finance of Vietnam promulgates Circular 29/2022/TT-BTC dated June 3, 2022 providing for codes, professional and professional standards, and salary classification for the ranks of officials specializing in accounting, tax, and customs. store, reserve.

According to the Circular, from July 18, 2022, the regulations on standards for advanced accounting qualifications will be changed as follows:

- Having a university degree or higher in accounting, auditing, or finance;

- Possessing an advanced diploma in political theory or an advanced political-administrative theory or a certificate of equivalent advanced level of political theory from a competent authority;

(Compared to the current Circular 77/2019/TT-BTC, the bachelor's degree in politics has been removed.)

- Possessing a certificate of state management knowledge and skills training for civil servants with the rank of senior expert or equivalent; or have an advanced degree in political-administrative theory.

(Requirements on certificates of foreign languages ​​and informatics compared to current regulations are removed and it stipulates that senior accountants must have basic information technology skills and use foreign languages.

In addition, an advanced degree in political theory can replace a certificate of state management knowledge and skills training for civil servants.)

Circular 29/2022/TT-BTC takes effect on July 18, 2022, replacing Circular 77/2019/TT-BTC.

3. High-altitude meteorology, ozone, and ultraviolet radiation standards

The Minister of Natural Resources and Environment of Vietnam issued Circular 04/2022/TT-BTNMT (effective July 18, 2022) requiring technical inspection, control, and assessment of the quality of aerial meteorological documents, weather radar, ozone, and ultraviolet radiation.

In which, the standards for documenting high-altitude meteorology, ozone and ultraviolet radiation are as follows:

- Legality, completeness, and consistency of paper documents and digital files: 20 points;

- Method of monitoring and adjusting means and measuring instruments: 10 points;

- Calculating data and electrical codes: 30 points;

- The rationality of data according to space, time and observed factors: 30 points;

- Physical condition and form of documents: 10 points.

4. Employees are allowed to temporarily reside and stay in industrial zones from July 15, 2022.

This is the content of Decree 35/2022/ND-CP dated May 28, 2022, on the management of industrial parks and economic zones.

Specifically, Article 25 of Decree 35/2022/ND-CP stipulates cases of temporary residence and stay in industrial parks as follows:

- There is no permanent place of residence in the industrial park as prescribed by the law on residence.

- Experts and employees are allowed to temporarily stay or stay at accommodation establishments in industrial parks to serve the production and business activities of enterprises and comply with the following provisions:

+ For experts and employees who are Vietnamese, they may temporarily reside or stay in accordance with the law on residence;

+ For experts and foreign employees, they shall temporarily reside in accordance with the regulations of the law on entry, exit, transit, and residence of foreigners in Vietnam.

- Accommodation is built in the service land area of ​​the industrial park to ensure a safe distance from the environment according to the provisions of the law on construction and other relevant provisions of law; ensure security and order and do not affect production and business activities of enterprises in industrial parks.

(Currently, residents are not allowed to live in industrial zones and export processing zones.

In case of necessity, foreigners (including managers, executives, and experts) are allowed to temporarily reside in enterprises in industrial parks or export processing zones according to regulations of the provincial People's Committee. The temporary residence of foreigners must satisfy the conditions in Clause 3, Article 29 of Decree 82/2018/ND-CP)

Decree 35/2022/ND-CP takes effect from July 15, 2022 and replaces Decree 82/2018/ND-CP (except for the case specified at Point a, Clause 3 and Clause 4, Article 74 of Decree 82/2018/ND-CP).
