Regulation on the salary scale for employees in state-owned single-member limited liability companies from April 10, 2024; applications for issuance of certificates of airport/aerodrome registration from April 10, 2024; standards of the award of the Ho Chi Minh Prize for scientific research works from April 10, 2024; etc., are notable new policies that will be covered in this bulletin.

Vietnam’s regulation on salary scale for employees in state-owned single-member limited liability companies from April 10, 2024

On February 23, 2024, the Government of Vietnam promulgated Decree No. 21/2024/ND-CP on amendments to Decree No. 51/2016/ND-CP on the management of employees, salaries, and bonus payments to employees in single-member limited liability companies of which charter capital is wholly owned by the State and Decree No. 52/2016/ND-CP on salaries, remunerations, and bonus payments to managers of single-member limited liability companies of which charter capital is wholly owned by the State.

According to the Decree, the salary scale, payroll, and allowances for employees working in state-owned single-member limited liability companies shall be implemented as follows: 

- Companies develop and issue salary scales, payrolls, and allowances as the basis for salary classification and payment and implementation of benefits for employees according to labor laws following their labor and production organization.

- Companies shall decide the salary rates in salary scales, payrolls, and allowances while ensuring that salary funds calculated based on salary rates in salary scales, payrolls, and allowances do not exceed the payroll budget according to Decree No. 51/2016/ND-CP.

- When developing or amending salary scales, payrolls, and allowances, companies shall consult with employee representative organizations at their facilities, organize conversations at workplaces as per regulation, submit reports to owner's representative agencies for suggestions, and disclose the development or amendments before the implementation.

Applications for issuance of certificates of airport/aerodrome registration in Vietnam from April 10, 2024 

On February 23, 2024, the Government of Vietnam promulgated Decree No. 20/2024/ND-CP on amendments to Decree No. 05/2021/ND-CP on the management and operation of airports and aerodromes and Decree No. 64/2022/ND-CP on amendments to Decrees on business operations in the civil aviation industry.

Specifically, the proprietor of an airport or aerodrome or the organization designated to manage such airport or aerodrome shall submit 1 application for issuance of the airport/aerodrome registration certificate to the Airport Authority, whether in person or by post or online or by another appropriate method.  The application includes: 

- The application form defined in Form No. 01 in the Appendix of decree No. 20/2024/ND-CP;

- A copy or electronic copy of the establishment decision of the proprietor or the organization designated to manage the airport or aerodrome (if the enterprise registration certificate is unavailable);

-  A copy or electronic copy of the decision on investment guidelines or decision on investment in the airport/aerodrome in the case of construction, renovation, upgrading, or expansion of the airport/aerodrome;

- A copy or electronic copy of the written confirmation of the completion of commissioning procedures regarding the airport/aerodrome infrastructure pursuant to regulations on construction investment in the case of construction, renovation, upgrading, or expansion of the airport/aerodrome.

Vietnam’s standards of award of Ho Chi Minh Prize for scientific research works from April 10, 2024

On February 21, 2024, the Government of Vietnam promulgated Decree No. 18/2024/ND-CP on the Ho Chi Minh Prize, State Award, and other awards concerning science and technology.

According to the Decree, scientific research works requested for the award of Ho Chi Minh Prizes shall meet the following standards: 

(1) Exceptionally outstanding works 

Research results of works contain new inventions or are outstanding and typical scientific achievements, leading to significant changes in awareness, production, national defense and security, and social life. 

(2) Works with high scientific values: 

- Works are able to discover the nature and development law of things and phenomena or achieve one of the following criteria: establishing new research directions; new ideologies or conceptions; new awareness; new approach methods; new theories; new methods; new knowledge; new scientific and technological discoveries; 

- Works are disclosed or cited in reputable domestic or international scientific magazines

(3) Works have major impacts on the revolutionary cause, broad and long-lasting influences on people's lives, or major contributions to the socio-economic development or have the following effects when being applied practically: 

- Bringing major economic efficiency or appropriately changing the structure of occupations and professions; saving production costs; improving labor productivity; reducing negative impacts on the environment; 

- Providing significant contributions to the prediction of future trends and planning and implementing guidelines and policies of the CPV and policies and laws of the State; 

- Shifting the awareness of society or having significant impacts on social lives; improving intellectual standards of the people; positively changing the behavior of social groups and classes; 

- Having great educational effects that are used for research work, university training, and post-university training.

Ministry of Public Security of Vietnam’s National Technical Regulations on Fire Protection Equipments from April 1, 2024 

On October 30, 2023, the Minister of Public Security of Vietnam promulgated Circular No. 56/2023/TT-BCA on the National Technical Regulations on Fire Protection Equipments. 

Specifically, the scope and regulated entities of the National Technical Regulations on Fire Protection Equipments (QCVN 03:2023/BCA) are as follows: 

(1) Scope 

QCVN 03:2023/BCA requirements in terms of limits of technical characteristics and management of inspection of fire protection equipments under list of mandatory inspection in fire protection in accordance with the law prior to being sold in Vietnam.

QCVN 03:2023/BCA does not apply to fire protection equipments imported in form of sample products or products for exhibition or display; fire protection equipments temporarily imported, or in transit and not for sale or use in Vietnam.

(2) Regulated entities

- Organizations and individuals manufacturing, assembling, domestically modifying, and importing fire protection equipments.

-  Agencies and organizations entitled to conduct fire protection equipment inspection.

- Agencies and organizations relevant to quality control of fire protection equipments.
