New and notable policies of Vietnam taking effect in the beginning of June 2022

LawNet would like to introduce new and notable policies of Vietnam that have come into force in the beginning of June 2022 (June 11 - 20)

1. From June 15, 2022, driver's license separation in Vietnam must have a medical examination certificate.

From June 15, 2022, Circular 04/2022/TT-BGTVT amendments to Circular 12/2017/TT-BGTVT dated april 15, 2017 of the minister of transport on driver training, driving tests, and issuance of driving licenses

According to this Circular, Circular 04/2022/TT-BGTVT amends Clause 2 of Article 38 of Circular 12/2017/TT-BGTVT as follows:

"Health examination record of drivers issued by competent medical establishments, except for A1, A2, A3 class driving license"

Thus, from June 15, 2022, a person who wishes to separate a fixed-term and indefinite driving license in Vietnam must have a medical examination certificate issued by a competent medical establishment.

2. Cases of complaints in the Police Office are not eligible for processing

This is the content of Circular 19/2022/TT-BCA regulating the receipt, classification and handling of complaints and petitions, reflected in the People's Public Security Forces.

According to this Circular, complaints in the police are not eligible for processing in Vietnam including:

- Applications that do not meet the requirements specified in Clause 1, Article 7 of Circular 19/2022/TT-BCA;

- Applications that are sent to many agencies, organizations, units or individuals including agencies, organizations, units or persons competent to settle but the agencies or units receiving the applications do not fall under the jurisdiction in Vietnam;

- Units whose contents have been transferred or have been instructed in accordance with regulations;

- Applications that contain contents that oppose the Party's lines, policies and laws of the State; Applications that contain the content of dividing national and religious solidarity; Applications that contain vulgar, libelous, insulting the honor and prestige of individuals, agencies, organizations or units in Vietnam;

- Rupture units, erased, unclear or illegible writings.

Circular 19/2022/TT-BCA takes effect from June 15, 2022.

3. Rejecting judicial expertise in the field of science and technology

Circular 03/2022/TT-BKHCN provides for judicial expertise in scientific and technological activities in Vietnam to replace Circular 35/2014/TT-BKHCN.

The Ministry of Science and Technology and specialized agencies in science and technology shall reject judicial expertise in the following cases:

- The contents of the expertise in Vietnam are not under their state management;

- The requests and requests for expertise are not in the field prescribed in Article 3 of Circular 03/2022/TT-BKHCN;

- There are no organizations or individuals with sufficient qualifications and conditions necessary for the expert examination;

- The objects of the expertise and relevant documents in Vietnam are provided inadequately or not valid for the conclusion of judicial expertise after requesting the requester and the requester for additional expertise, but are not met. (New content added)

Circular 03/2022/TT-BKHCN takes effect from June 15, 2022 .

4. Additional tasks of the Finance – Planning Department in Vietnam

This is the content of Circular 05/2022/TT-BKHDT guiding the functions, tasks and powers of the Department of Planning and Investment and the Department of Finance and Planning in Vietnam.

According to this Circular, the Finance – Planning Department performs the function of advising and assisting the District People's Committee in state management on:

- Planning in the district;

- Department of Planning and investment in;

- Registration of business households, registration of cooperatives in Vietnam;

- General and unified management of issues of collective economy, cooperatives, business households, private economy in accordance with the law in Vietnam (Compared with the current supplement of business households).

Circular 05/2022/TT-BKHDT takes effect from June 20, 2022 and replaces Joint Circular 21/2015/TTLT-BKHDT-BNV.
