The latest college charter currently is prescribed in Circular 15/2021/TT-BLDTBXH.

Based on Circular 15/2021/TT-BLDTBXH on the regulation of the college charter issued by the Minister of Labor, War Invalids, and Social Affairs, it specifies the following:

(1) The Minister of Labor, War Invalids, and Social Affairs issued Circular 15/2021/TT-BLDTBXH on the regulation of the college charter.

(2) The college charter comprises 8 Chapters and 59 Articles.

(3) Scope of regulation

Circular 15/2021/TT-BLDTBXH regulates the college charter, including: Tasks and powers; organization and management of the college; organization of training activities; educators, management staff, public employees, workers, and learners in the college; finance and property of the college; relationships between the school and enterprises, vocational education institutions, education institutions, families of learners, and society; implementation of the college charter.

(4) Applicability

- Circular 15/2021/TT-BLDTBXH applies to colleges and organizations, individuals participating in activities at the college.

- Colleges with foreign investment are autonomous in organizational structure and implement other contents following the regulations on private colleges specified in Circular 15/2021/TT-BLDTBXH.

- Circular 15/2021/TT-BLDTBXH does not apply to pedagogical colleges.

What are the principles for naming colleges according to the latest college charter in Vietnam?

According to Article 4 of Circular 15/2021/TT-BLDTBXH on the college charter, the principles for naming colleges are as follows:

* The Vietnamese name of the college consists of the element specified in point (1) and one or more elements specified in points (2), (3), (4), and (5):

(1) The phrase identifying the type of vocational education institution: College;

(2) The phrase identifying the type of training, field, or major training;

(3) The phrase identifying the proper name: name of localities; name of cultural or historical figures; name of individuals, organizations managing or owning the college. The phrase identifying the name of the locality must be associated with the place where the college's main office is located;

(4) The phrase identifying quality, level: When meeting quality criteria according to regulations and recognized by competent authorities or organizations;

(5) The phrase associated with regional, international, foreign national names: regional, international, foreign national names must be associated with national-level cooperation agreements or cooperation or joint programs with foreign national schools or programs achieving standards of regional, international, foreign nationals.

* The naming must be clear, not cause misunderstanding about the organization's structure and activities; appropriate with historical traditions, culture, ethics, and customs of the nation; not cause confusion about quality or level of the college.

* The name of the college must not duplicate or cause confusion with names of previously established colleges.

* The international transaction name of the college must be translated from Vietnamese to a foreign language, using terms appropriate for international customs, not translating personal names, and not causing confusion with other schools.

* The Vietnamese name of the school is recorded in the establishment or permit decision, the seal, the signboard, correspondence, and documents of the school and must be displayed at the main office, branches of the school.

What is the organization and operation regulation of colleges according to the college charter in Vietnam?

According to Article 7 of Circular 15/2021/TT-BLDTBXH, the organization and operation regulation of colleges are issued by the principal following the resolution of the school council for public colleges or following the resolution of the board of directors for private colleges based on concretizing regulations in Circular 15/2021/TT-BLDTBXH, suitable with the characteristics of the school, without contradicting relevant laws.

Colleges under the people's armed forces apply according to the above regulations and regulations for units under the people's armed forces.

The organization and operation regulation of colleges include the following main contents:

- School name, abbreviation (if any);

- Mission;

- Objectives;

- Duties, powers of the school;

- Organization of training, scientific research, technology and production services, international cooperation;

- Duties and rights of educators, management staff, public employees, workers;

- Duties and rights of learners;

- Organization and management of the school;

- Finance and property;

- Relationships between the school and enterprises, vocational education institutions, education institutions, families of learners, and society;

- Inspection, testing, rewards, and handling of violations.

Additionally, the organization and operation regulation of colleges must be publicly announced within the school after issuance.

The principal of the college issues amendments and supplements to the organization and operation regulation of their school according to the provisions of Clauses 1, 2, and 3 of Article 7 of Circular 15/2021/TT-BLDTBXH.
