What is the current Law on Education in Vietnam?

The current applicable Law on Education is the Law on Education 2019, passed by the National Assembly in its 14th tenure during the 7th session on June 14, 2019.

Law on Education 2019 includes 9 Chapters and 115 Articles.

Law on Education 2019 stipulates the national education system; educational institutions, educators, and learners; state management of education; and the rights and responsibilities of agencies, organizations, individuals related to educational activities.

It clearly states:

The objective of education is to develop the Vietnamese people comprehensively with ethics, knowledge, culture, health, aesthetics, and profession; with qualities, capabilities, and civic consciousness; with patriotism, national spirit, loyalty to the ideals of national independence, and socialism; to unleash the potential and creativity of each individual; to enhance public intellect, develop human resources, nurture talents, and meet the requirements of nation building, defense, and international integration.

Which documents guide the current Law on Education?

Several Decrees and Circulars are used to guide the implementation of the Law on Education 2019, including:

- Circular 07/2024/TT-BGDDT amends Article 7 and replaces Appendix 2, Appendix 3 of Circular 13/2021/TT-BGDDT regulating the conditions, procedures, authority for recognizing diplomas issued by foreign educational institutions for use in Vietnam, issued by the Minister of Education and Training.

- Decree 97/2023/ND-CP amends Decree 81/2021/ND-CP regulating the mechanism for tuition fee collection and management for educational institutions in the national education system and policies for tuition exemption, reduction, and learning support; service prices in the field of education and training.

- Circular 23/2023/TT-BGDDT stipulates Vietnamese language teaching for ethnic minority children before entering the first grade, issued by the Ministry of Education and Training.

- Circular 27/2023/TT-BGDDT regulates the selection of textbooks in general education institutions, issued by the Minister of Education and Training.

- Circular 13/2023/TT-BGDDT stipulates the supervision and evaluation of higher education quality accreditation organizations issued by the Minister of Education and Training.

- Decree 103/2022/ND-CP regulates schools of state agencies, political organizations, socio-political organizations, and the armed forces.

- Circular 15/2022/TT-BGDDT regulates the teaching of high school cultural knowledge in vocational education institutions, issued by the Minister of Education and Training.

- Circular 13/2022/TT-BGDDT amends content in the general education curriculum attached to Circular 32/2018/TT-BGDDT, issued by the Minister of Education and Training.

- Circular 10/2022/TT-BGDDT regulates the assessment of learners in the Literacy Eradication Program, issued by the Minister of Education and Training.

- Circular 33/2021/TT-BGDDT concerning the Literacy Eradication Program, issued by the Minister of Education and Training.

- Decree 86/2021/ND-CP regulates Vietnamese citizens studying, teaching, conducting scientific research, and academic exchange abroad.

- Decree 81/2021/ND-CP regulates the mechanism for tuition fee collection and management for educational institutions in the national education system and policies for tuition exemption, reduction, and learning support; service prices in the field of education and training.

- Circular 13/2021/TT-BGDDT regulates the conditions, procedures, authority for recognizing diplomas issued by foreign educational institutions for use in Vietnam, issued by the Minister of Education and Training.

- Decree 24/2021/ND-CP regulates management in public preschool and general educational institutions.

- Circular 47/2020/TT-BGDDT regulates the selection of toys and learning materials used in preschool educational institutions, issued by the Minister of Education and Training.

- Circular 49/2020/TT-BGDDT concerning the standards, procedures for compiling, and revising the preschool education program; organization and activities of the National Council for Appraising Preschool Educational Programs, issued by the Minister of Education and Training.

- Circular 51/2020/TT-BGDDT amends the Preschool Education Program.

- Decree 105/2020/ND-CP regulates policies for developing preschool education.

- Decree 84/2020/ND-CP provides guidance on the Law on Education 2019.

- Decree 71/2020/ND-CP regulates the roadmap for enhancing the standard training level of preschool, primary, and secondary school teachers.

What is the perspective on education development in the Law on Education in Vietnam?

According to Article 4 of the Law on Education 2019, the perspective on education development is as follows:

- Education development is the foremost national policy.

- Education development must be linked with the needs of economic – social development, scientific and technological progress, and strengthening national defense and security; implementing standardization, modernization, private investment; ensuring balance in the structure of occupations, qualifications, and human resources relevant to regions; expanding the scale based on ensuring quality and efficiency; integrating training with utilization.

- Developing an open education system, building a learning society to create opportunities for everyone to access education, learn at all levels, in all forms, and to learn for life.
