Cases where extra classes are not allowed in Vietnam

According to Clause 1, Article 2 of the Regulations on extra classes, issued together with Circular 17/2012/TT-BGDDT, extra classes are an additional teaching activity that charges students, with content based on the general education program but outside the educational plan of the general education program issued by the Ministry of Education and Training.

Based on Article 4 of the Regulations on extra classes, issued together with Circular 17/2012/TT-BGDDT, the cases where extra classes are not allowed include:

- No extra classes for students who are already receiving instruction in two sessions/day organized by the school.

- No extra classes for primary school students, except in cases of: training in arts, physical education, or life skills.

- Universities, colleges, professional secondary schools, and vocational schools are not to organize extra classes in content according to the general education program.

- For teachers receiving salaries from the public service provider's wage fund:

+ Not allowed to organize extra classes outside the school but may participate in extra classes outside the school;

+ Not allowed to tutor outside the school for students whom the teacher is currently teaching officially without the permission of the head of the teacher's managing authority.

What are the principles of extra classes in Vietnam?

Based on Article 3 of the Regulations on extra classes, issued together with Circular 17/2012/TT-BGDDT, the principles of extra classes in Vietnam are as follows:

- extra classes activities should contribute to consolidating and enhancing students' knowledge, skills, and character; be appropriate to psychological characteristics, not causing an overload for students.

- Do not reduce content from the official general education program to include in extra classes hours; do not tutor ahead of the general education program’s content.

- extra classes targets students who have the need and voluntary desire to participate, with the consent of their families; any form of forcing families or students to participate in extra classes are not allowed.

- Do not organize extra classes classes following the official class format; students within the same extra classes class should have equivalent academic abilities; class assignments should rely on students' academic proficiency.

- Organizations or individuals organizing extra classes activities must be responsible for the registered contents and obtain permission for organizing extra classes activities.

What are the regulations on collection and management of fees for extra classes in Vietnam?

According to Article 7 of the Regulations on extra classes, issued together with Circular 17/2012/TT-BGDDT, the collection and management of fees for extra classes in Vietnam are regulated as follows:

- For in-school extra classes:

+ Collect extra classes fees to pay remuneration for teachers directly involved in extra classes, manage extra classes activities in the school, cover electricity, water, and repair costs of facilities for extra classes;

+ The extra classes fee rate is agreed upon between the parents and the school;

+ The school organizes the collection, expenditure, and publicly accounts for the extra classes fee through the school's financial department; extra classes teachers do not directly collect or spend extra classes fees.

- For out-of-school extra classes:

+ The extra classes fee rate is agreed upon between the parents and the organizing entity or individual.

+ The organizing entity or individual must comply with current financial management regulations regarding extra classes fees.

What are the responsibilities of external extra class providers in Vietnam?

Based on Article 20 of the Regulations on extra classes, issued together with Circular 17/2012/TT-BGDDT, the responsibilities of external extra class providers in Vietnam are as follows:

- Comply with the regulations on extra classes of the Ministry of Education and Training, provincial People's Committees, and other relevant legal provisions.

- Manage and ensure the rights of extra classes participants and tutors. If extra classes are temporarily suspended or terminated, report to the licensing authority and publicly notify participants at least 30 days in advance. Refund collected fees proportionate to unprovided extra classes services, and fully settle finances with tutors and related entities.

- Manage, retain, and present extra classes records when inspected or audited, including: extra classes activity licensing records; list of tutors; list of participants; extra classes schedules; extra classes application forms, and financial records as per current regulations.

- Subject to inspection and audit by the authorities and the education management entities at all levels for compliance with extra classes regulations; periodically report to the managing authority.
