According to Article 11 of the Draft Circular on the Issuance of Regulations for Organizing Examinations and Issuing Language Certificates based on the Six-level Foreign Language Proficiency Framework for Vietnam, the following regulations are stipulated for handling candidates violating exam regulations:
- Candidates who violate exam regulations must have a report written, be dealt with, and be informed of the violation.
- Depending on the nature and degree of violation, the organizing unit will consider deciding the form of handling for the candidate such as reprimand, warning, suspension, or cancellation of exam results. The following acts will result in a ban from taking exams at all language proficiency assessment organizations for a period of 02 years:
+ Having someone else take the exam for them or taking the exam for someone else by any means;
+ Acts of causing disruption, damaging the exam; assaulting the organizers or other candidates.
- Data from surveillance cameras is one of the official bases for considering and handling violations of exam regulations.

What are the fines for organizing units violating the Regulations of the Language Proficiency Assessment Examination in Vietnam?
According to Article 10 of the Draft Circular on the Issuance of Regulations for Organizing Examinations and Issuing Language Certificates based on the Six-level Foreign Language Proficiency Framework for Vietnam Download, it is stipulated on the handling of organizing units, participants in organizing the exam, and other related individuals violating exam regulations as follows:
- Depending on the degree of violation by the organizing unit, the Ministry of Education and Training will consider suspending or not recognizing the organization of foreign language proficiency assessment according to the Six-level Foreign Language Proficiency Framework for Vietnam of the units.
- Participants in organizing the exam and other related individuals who violate exam regulations (discovered during or after the exam) will be handled according to current legal provisions.
How to construct a standardized question bank for Language Proficiency Assessment Exams in Vietnam according to procedures and content?
According to Section 2, Appendix 1 of the Draft Circular on the Issuance of Regulations for Organizing Examinations and Issuing Language Certificates based on the Six-level Foreign Language Proficiency Framework for Vietnam Download, regulations on the procedure and content for constructing a question bank are as follows:
Step 1: Establish a group of experts and a coordinating team to construct a standardized question bank
Based on the task requirements of each stage; based on the capacity and work efficiency of the staff and experts, establish a group of experts to participate in constructing the standardized question bank and a coordinating team for each specific task.
Step 2: Build the exam matrix and design the exam specification (based on the exam format of the language proficiency assessment as regulated by the Ministry of Education and Training)
Organize focused work by expert groups to build the exam matrix and exam specifications for each field including: assessment objectives, question types, proficiency levels to be assessed, knowledge areas, question difficulty, and other requirements (if needed). For exams that already have an exam matrix and approved exam specifications by the competent authority, when constructing the standardized question bank, a detailed specification suitable for the question bank must be built.
Step 3: Draft raw questions
Arrange focused work on each foreign language subject and perform the following tasks:
- Based on the exam specification, the group leader assigns tasks for writing questions to each member and guides the members in drafting exam questions; each member in the group creates ideas and drafts the content of questions and answers directly on a computer not connected to external networks.
After members complete drafting, the group leader is responsible for reviewing, editing, and approving each exam question;
- At the end of each drafting phase, experts hand over products to the coordinating officer and sign the handover minutes. The group leader prepares an aggregate table of the number of raw questions drafted by each member, signs to confirm, and submits it to the coordinating officer.
Step 4: Review, filter, edit, and validate questions
- Experts review the content of questions for professional content, leading text, and question format ensuring compliance with the exam specification;
- Technical question experts review the question writing technique, leading text, and answer options;
- Editors make direct corrections and propose any necessary modifications (if any) for each question;
- After receiving the editor's feedback, the question draft expert (author) directly edits the questions;
- Each group's leader will read the review and validation opinions of experts, review the author's edits, directly make adjustments, and finalize questions.
Step 5: Trial, analyze, and evaluate questions
- Questions after being validated and edited will be compiled for trial and evaluation;
- Implement question trials, ensuring a minimum sample of 50 students;
- After completing the trial activity, enter/extract response data from candidates; clean collected data for analysis preparation;
- Experts analyze the exam questions using specialized testing software to perform standard parameter analysis of questions, recommend necessary adjustments, or eliminate unsuitable questions.
Step 6: Edit questions post-trial
- Based on the question analysis expert's report, organize groups of experts to implement question edits;
- Groups edit questions according to analytical results to ensure questions fit the approved exam specification.
Step 7: Compile exams, trial, analyze, evaluate, balance the difficulty of exams
- Questions post-editing will be structured into exams following exactly the exam specification for trial;
- Conduct exam trials, ensuring each exam has at least 50 students attempting;
- After completing the trial activity, enter/extract response data from candidates; clean collected data for analysis preparation;
- Experts use specialized software to analyze exams, evaluate difficulty, balance among exams, and with standardized sample exams; recommend necessary adjustments, or eliminate unsuitable questions in each exam.
Step 8: Edit questions post-exam trial
- Based on the question analysis expert's report, organize groups of experts to implement question edits;
- Groups edit questions according to analytical results to ensure questions fit the approved exam specification.
Step 9: Review, select, and enter questions into the standardized question bank
Questions revised and finalized after trials will be reviewed and selected by the expert group to be entered into the standardized question bank.
