Based on Article 5 of Decree 14/2020/ND-CP regarding the application for enjoyment of allowance, the required documents are:

Application for enjoyment of allowance

1. For teachers receiving pension: application form for enjoyment of allowance issued along with this Decree (Form No. 01).

2. For teachers eligible for allowance but who have not yet settled the benefits and passed away from January 01, 2012 onwards, the application includes:

a) Application form for enjoyment of allowance by the kin, issued along with this Decree (Form No. 02).

b) Copy of Death Certificate or Death Notice or Court's Decision declaring death (bring the original for comparison).

c) Authorization letter as prescribed in Clause 2, Article 4 of this Decree (Form No. 03); in cases where there is only one kin, this authorization document is not required.

Thus, for teachers receiving pension, the application for enjoyment of allowance includes an application form for enjoyment of allowance.

What are the conditions for enjoyment of seniority allowance for teachers currently receiving pension in Vietnam?

Under Article 3 of Decree 14/2020/ND-CP,  the conditions for enjoyment of seniority allowance for teachers currently receiving pension in Vietnam as follows:

Conditions for enjoyment of seniority

Teachers stipulated in Article 2 of this Decree are eligible for allowances when they meet the following conditions:

1. Directly teach, educatie, guide practice, and participate in social insurance for 5 years (full 60 months) or more;

2. Have retired between January 01, 1994, and May 31, 2011.

3. Receive a pension as of January 01, 2012. In cases where pension are temporarily suspended according to the provisions of the Law on Social Insurance  , the allowance will be received after the pension is reinstated.

Thus, teachers currently receiving pension are eligible for the seniority allowance when they meet the following conditions:

Firstly, be a teacher currently receiving pension who has not received seniority allowance as per Article 2 of Decree 14/2020/ND-CP:

(1) Teachers who are educators, lecturers, child caretakers, principals, vice principals, nursery heads, deputy nursery heads, directors, deputy directors, heads of faculties, deputy heads of faculties, heads of departments, deputy heads of departments, heads of offices, deputy heads of offices, retired while directly teaching, educating, guiding practice or waiting for retirement age and preserving the period of social insurance contribution to receive pensions between January 01, 1994, and May 31, 2011, at the following public educational institutions:

+ Preschool educational institutions;

+ General educational institutions;

+ Vocational educational institutions;

+ Higher educational institutions;

+ Continuing educational institutions;

+ Academies, schools, and centers responsible for training, and retraining under state agencies, political organizations, and socio-political organizations.

(2) Teachers retired while directly teaching, educating, or waiting for retirement age and preserving the period of social insurance contribution to receive pensions between January 01, 1994, and May 31, 2011, at semi-public educational institutions, but previously transferred from public educational institutions or at semi-public educational institutions converted from public educational institutions by competent authorities, ranked according to the salary scale of the wage categories of public employees in the education sector.

(3) Teachers engaged in teaching and education at public educational institutions sent by competent authorities overseas as educational experts, immediately retiring upon returning home after the expert assignment period.

(4) Teachers who have retired have participated in teaching at classes organized at youth volunteer units but have not received the policies and state benefits for youth volunteers; teachers who are soldiers, police, and cipher workers later transferred to teaching and education at public educational institutions retired as teachers, lecturers in pension with armed forces seniority allowance but without teacher seniority allowance.

Secondly, directly teach, educatie, guide practice, and participate in social insurance for 5 years (full 60 months) or more;

Thirdly, have retired between January 01, 1994, and May 31, 2011.

Fourthly, receive a pension as of January 01, 2012.

Note: In cases where pension are temporarily suspended according to the provisions of Law on Social Insurance 2014, the allowance will be given after the pension is reinstated.
