Suspension of Training Activities in the Training Discipline

1. An educational institution shall have its enrollment activities suspended in a training discipline in the following cases:

a) The discipline has been opened without maintaining the full conditions required for its operation as stipulated in this Circular;

b) Violating other legal regulations on education, resulting in the necessity to suspend enrollment activities.

2. An educational institution shall have its training activities suspended in a training discipline in the following cases:

a) Self-initiation or fraudulent practice to open a training discipline without meeting the stipulated conditions;

b) Failure to remedy the causes leading to the suspension of enrollment activities after the suspension period ends;

c) Violating other legal education regulations to the extent that training activities must be suspended.

Thus, an educational institution will be suspended from conducting training activities in the training discipline in the following three cases:

- Self-initiation or fraudulent practice to open a training discipline without meeting the stipulated conditions;

- Failure to remedy the causes leading to the suspension of enrollment activities after the suspension period ends;

- Violation of other legal education regulations to the extent that training activities must be suspended.

What is the authority to decide on the suspension of training activities for a specific educational program in Vietnam from January 5, 2025?

3. The Minister of Education and Training decides on the suspension of enrollment or training activities in a training discipline when there is a conclusion from a competent state management agency about violations as prescribed in Clauses 1 and 2 of this Article; the suspension period ranges from 6 months to 12 months based on the degree and nature of the violation. The suspension decision must clearly state the reason, scope, suspension period, and be publicly announced through mass media.

4. The educational institution with suspended enrollment or training activities in a training discipline as stipulated in Clause 3 of this Article must implement measures to ensure the legitimate rights and interests of students, lecturers, management staff, and employees of the educational institution.

5. During the enrollment suspension period, if the educational institution has remedied the causes leading to the suspension and fully meets the conditions for opening a training discipline as stipulated in this Circular, the Minister of Education and Training will decide to allow the resumption of enrollment in the training discipline within 30 days from the end of the suspension period.

Pursuant to Clause 3, Article 10 of Circular 02/2022/TT-BGDDT regarding the appraisal of the training discipline proposal:

- The Science and Training Council organizes the appraisal of the proposal to open a training discipline, where the appraisal council must consider and assess the actual conditions of the educational institution based on the provisions of Circular 02/2022/TT-BGDDT, the regulations of the educational institution, and the current legal regulations, evaluating the level of compliance with the requirements for opening a discipline for each specific aspect of the proposal, including appraising conditions such as the name of the training discipline, training program, faculty team, facilities, readiness to transition to online teaching-learning, and the organizational management work concerning the training discipline proposed for opening.

- The appraisal results of the proposal to open a training discipline by the Science and Training Council must be documented in the appraisal minutes and must conclude specifically whether the educational institution has met the conditions to open the training discipline or not as specified in Circular 02/2022/TT-BGDDT, the institution's regulations, and the current legal provisions.

During the appraisal process, the Science and Training Council must check the actual conditions and verify specific evidence before concluding, simultaneously reporting to the principal of the educational institution and being responsible for explaining the appraisal results.

- The educational institution specifically regulates the working principles of the Science and Training Council when organizing the appraisal of the training discipline proposal, clearly stipulating the responsibilities and powers of the council and its members.
