Regarding this matter, LawNet would like to answer as follows: 

On May 13, 2024, the Vietnam Social Security issued Official Dispatch1371/BHXH-TCCB on guidance on certain matters related to probation for public employees.

Based on this, in order for units to promptly carry out the probation-related matters for successful candidates in the recruitment of public employee, the Vietnam Social Security provides the following guidance:

(1) Procedures for deciding on the appointment of instructors guiding probationer

- For specialized units assisting the General Director:

+ Based on the recruitment decision for successful public employee made by the General Director, the heads of specialized units assisting the General Director submit a proposal to appoint an instructor to the Department of Organization and Personnel no later than 2 days from the date the public employee receives the job.

The Head of the Department of Organization and Personnel issues a decision to appoint a instructor no later than 3 working days from the date of receiving the proposal from the units.

- For public service providers under the Vietnam Social Security; Social Insurance of provinces and centrally-affiliated cities (hereinafter referred to as provincial Social Insurance):

Based on the recruitment decision for successful public employees made by the Director General of the Vietnam Social Security, the heads of units where the probation takes place (departments under public service providers of the Social Insurance of Vietnam; departments or district-level Social Insurance under provincial Social Insurance) submit a proposal to appoint a instructor to the Department of Organization and Personnel or the Department of Organization - Administration, Office, Administrative and Judicial Department (hereinafter referred to as the advisory unit for personnel organization work) no later than 2 working days from the date the public employee receives the job.

The advisory unit for personnel organization work submits the decision to appoint a instructor to the heads of career units and the Director of the provincial Social Insurance no later than 3 working days from the date of receiving the proposal to appoint a instructor.

The policies and regulations regarding instructors are implemented in accordance with Article 4 and Article 5 of Decree 115/2020/ND-CP.

(2) Appointment to the professional title of public employees for probationers after completing the probation period:

- When the probation period ends, the probationer and the instructor carry out the following:

The probationer must report the results of the probation period in writing according to the regulations in Article 3 of Decree 115/2020/ND-CP;

The instructor is responsible for evaluating the results of the probation period for the probationer in writing to submit for the issuance of a decision on appointment to the professional title of public employee and salary placement according to the authority.

No later than 2 working days from the date of receiving the probationer's report and the evaluation of the instructor, the head of the unit where the probation takes place evaluates the political qualities, ethics, and work results of the probationer.

In cases where the probationer meets the requirements, the head of the unit where the probation takes place submits a proposal for the decision on appointment to the professional title and salary placement for the public employee recruited according to the authority specified in Article 2 and Article 3 of Decision 2935/QD-BHXH dated October 10, 2022, by the General Director of the Social Insurance of Vietnam.
