Documents and deadlines for submitting the annual staffing plan in public service providers are stipulated in Decree 106/2020/ND-CP of Vietnam's Government.

1. Documentation and deadline for submitting the annual workforce quantity plan in public service providers

Documentation and deadline for submitting the annual workforce quantity plan in public service providers are specified in Article 10 of Decree 106/2020/ND-CP of Vietnam's Government as follows:

- The annual workforce plan file of public service providers under the management scope of ministries, central authorities, and local authorities includes:

+ A proposal document;

+ The workforce plan of public service providers under the management of ministries, central authorities, and local authorities as stipulated in Clause 2, Article 10 of Decree 106/2020/ND-CP, along with documents substantiating the workforce determination;

+ Copies of documents from competent authorities deciding or approving the workforce in public service providers of the unit or of ministries, central authorities, or local authorities from the year immediately preceding the plan year;

+ Related documents (if any).

- The content of the workforce plan includes:

+ The necessity of setting up the annual workforce plan;

+ A report evaluating the assignment and use of the workforce for the year immediately preceding the plan year and at the time of plan establishment;

+ Determining the workforce with statistics, aggregating workforce data for the plan year according to Appendix IA, Appendix IB, Appendix IIA, and Appendix IIB attached to Decree 106/2020/ND-CP;

+ Solutions for implementing the workforce plan after obtaining approval from competent authorities, the expected source of public employees, supplementary, and replacement labor contracts, implementation of the staff reduction policy, and budget estimates for execution;

+ Recommendations and proposals.

- The timeline for sending the annual workforce plan of ministries, central authorities, and local authorities:

+ By May 01 each year, ministries, central authorities, and local authorities must send the workforce plan for public service providers for the following year to the Ministry of Home Affairs.

+ After the timeline regulated in Point a, Clause 3, Article 10 of Decree 106/2020/ND-CP, if ministries, central authorities, and local authorities fail to submit the workforce plan for public service providers for the following year, the Ministry of Home Affairs will notify the total workforce enjoying salaries from the state budget in public service providers partially covering their own recurrent expenditures and public service providers guaranteed by the state budget with a higher staff reduction rate of 1% higher than the stipulated reduction rate.

2. Procedure for approving the annual workforce in public service provider

The procedure for approving the annual workforce in public service providers is specified in Article 9 of Decree 106/2020/ND-CP as follows:

- Public service providers self-financing their regular and investment expenditures and public service providers self-financing their regular expenditures follow Clause 2, Article 4 of Decree 106/2020/ND-CP and guidelines from competent authorities regarding workforce standards in public service providers by sector and field to develop the annual workforce plan, conduct assessment, and present it to the head of the public service provider for approval.

In case a public service provider has a Management Board, the head must present the plan to the Management Board for approval before deciding on the workforce.

- Public service providers partially covering their own recurrent expenditures and public service providers guaranteed by the state budget:

+ Following Clause 2, Article 4 of Decree 106/2020/ND-CP and guidelines from competent authorities regarding workforce standards in public service providers by sector and field, public service providers develop the annual workforce plan for employees paid from the state budget. They report to their direct managing agency, which in turn reports to the agencies or organizations specified in Point b of this clause. For public service providers partially covering their own recurrent expenditures, the workforce plan includes: the number of employees paid from the state budget and the number of employees paid from operational revenues.

+ Agencies and organizations assigned with organizational and staffing tasks for ministries, central authorities, and local authorities receive the files, conduct the evaluation of the workforce in public service providers, aggregate the workforce in public service providers partially covering their own recurrent expenditures and public service providers guaranteed by the state budget, and present it to the heads of ministries, central authorities, and local authorities to submit to the Ministry of Home Affairs for evaluation.

+ The Ministry of Home Affairs evaluates the workforce plan for employees paid from the state budget in public service providers partially covering their own recurrent expenditures and public service providers guaranteed by the state budget under the management of ministries, central authorities, and local authorities.

+ The Minister, Head of an agency under the Government of Vietnam, the Head of an organization established by the Government of Vietnam, the Prime Minister but not a public service provider, the Director of Hanoi National University, and the Director of Ho Chi Minh City National University decide on assigning the workforce paid from the state budget to each public service provider partially covering their own recurrent expenditures, and public service providers guaranteed by the state budget under their management, within the total number of employees approved by the Ministry of Home Affairs. They also decide on the workforce paid from operational revenues for public service providers partially covering their own recurrent expenditures under their management.

+ The provincial People's Committee presents the provincial People's Council with the workforce plan for employees paid from the state budget in public service providers partially covering their own recurrent expenditures and public service providers guaranteed by the state budget under their management, ensuring it fits within the total approved by the Ministry of Home Affairs. They then decide on the workforce paid from operational revenues for public service providers partially covering their own recurrent expenditures under their management.
