1. Type of houses developed in housing investment and construction projects and standard housing area in Vietnam

Type of houses developed in housing investment and construction projects and standard housing area in Vietnam according to Article 31 of the Housing Law 2023 are as follows:

- The types of housing developed under housing construction investment projects include:

+ Development of commercial housing;

+ Development of social housing, worker accommodation in industrial zones, housing for the people's armed forces;

+ Development of official residences;

+ Development of housing for resettlement;

+ Renovation and reconstruction of apartment buildings;

+ Development of mixed-use housing types as specified in this clause according to the provisions of the Housing Law 2023.

- Housing must be designed and constructed according to the provisions of the Housing Law 2023 and must comply with building standards and regulations; for apartments, they must be designed and constructed with full facilities and have a floor area not less than the minimum specified in the national technical regulation on apartments; in rural areas, housing construction must also comply with local customs, traditions, and rural housing architecture of each region and must include auxiliary works to serve the living and production needs of families and individuals.

2. Requirements of housing investment and construction projects in Vietnam

Requirements of housing investment and construction projects in Vietnam according to Article 33 of the Housing Law 2023 are as follows:

- Housing construction investment projects stated in Clause 1, Article 30 of the Housing Law 2023 must ensure the following general requirements:

+ In line with the approved provincial housing development program and plan, adhering to the content of the investment policy already decided or approved, and meeting the requirements specified in Article 5 of the Housing Law 2023; implement according to the approved detailed planning;

+ Any subdivision of component projects (if any) and investment phases must be determined in the investment policy, feasibility study report, and investment decision according to the laws on investment, public investment, and construction;

+ Housing construction investment projects and areas within them must be named in Vietnamese; for social housing projects, housing for the people's armed forces, and housing for resettlement, the investor must name them in Vietnamese; if the investor wishes to name commercial housing projects or renovation projects with foreign names, the full Vietnamese name must be written first, followed by the foreign name. The project name and the names of areas within the project must be stated in the investment policy or approved project content and used throughout the construction and management phase after completion;

+ The approved project content must be fully implemented by the investor; if there is a need to adjust the project content that requires adjusting the investment policy, the investor must go through the procedure to adjust the investment policy according to the law before altering the project content;

+ The acceptance and handover of housing and technical and social infrastructure works must comply with the provisions of the Housing Law 2023, the construction law, and other relevant legal provisions; ensuring quality, safety in construction, operation, exploitation, use of works, and requirements for fire prevention, firefighting, and environmental protection. In areas affected by climate change, it must also meet disaster response and climate change adaptation requirements as per legal provisions;

+ Housing construction investment projects applying energy-saving technology, resource-saving practices, green buildings, or smart urban practices must meet technical standards and criteria as prescribed by law; for apartment buildings, telecommunications and information infrastructure systems must be designed and installed according to legal requirements.

- Mixed-use housing construction investment projects stated in Clause 1, Point b, Article 30 of the Housing Law 2023 must comply with the requirements in Clause 1, Article 33 of the Housing Law 2023 and the following requirements:

+ Clearly define the purposes for residential use and for office or commercial, service, or other purposes in the determined or approved project investment policy;

+ The approved project content must clearly specify the ability or inability to segregate different functional areas; if separable, equipment systems for shared use for each functional area and the entire mixed-use housing project must be designed and built separately to ensure management and operation after being put into use;

+ Ensure synchronized technical and social infrastructure systems within and outside the project area.

- Housing construction investment projects specified at Points c, d, dd, and e, Clause 1, Article 30 of the Housing Law 2023 must comply with the requirements in Clause 1, Article 33 of the Housing Law 2023 and the following requirements:

+ Must have a comprehensive technical and social infrastructure system meeting planning criteria as per planning laws, ensuring connectivity with the area's general technical infrastructure system;

+ Responsibilities for investment, construction, and management of technical and social infrastructure works of the project must be determined in the project's investment policy as per laws on investment, public investment, and construction;

+ When transferring land use rights to individuals for self-construction of housing as per the Housing Law 2023 and other relevant legal provisions, the approved project content must clearly define the area, location for investment in housing construction, and the area, location where land use rights can be transferred for self-construction of housing by individuals.

- In addition to the requirements specified in Clauses 1, 2, and 3, Article 33 of the Housing Law 2023, housing construction investment projects must also meet other requirements corresponding to each type of housing construction investment project specified in Articles 49, 53, 60, 81, 95, and 105 of the Housing Law 2023 and other relevant legal provisions.

- The list of housing construction investment projects under implementation in the province or centrally administered city must be publicly listed on the electronic portal of the provincial People's Committee and the provincial housing management agency.
