Procedures for registering standard form contracts and general trading conditions within the local authorities in Vietnam are stipulated in Decision 2017/QD-BCT of 2024.

(1) Execution sequence

- Organizations and individuals registering standard contracts, and general transaction conditions in Vietnam shall prepare one set of documents as stipulated in Clause 1, Article 8 of Decree 55/2024/ND-CP, and submit it by post, directly, or online in the electronic environment to the state management agency for consumer protection under the Provincial People's Committee (the state management agency for consumer protection);

- Organizations and business individuals submitting the dossier receive a receipt note, specifying the time of receipt and the date of result issuance.

- Within 5 working days from the reception of the dossier, the Provincial People's Committee (the state management agency for consumer protection) is responsible for checking the completeness and validity of the dossier.

If the dossier is incomplete or invalid, the Provincial People's Committee (the state management agency for consumer protection) shall notify in writing according to Form No. 03 in the Appendix issued with Decree 55/2024/ND-CP for the organization or business individual to amend and supplement the dossier.

If the dossier is complete and valid, the Provincial People's Committee (the state management agency for consumer protection) shall assess the dossier as regulated.

- The state management agency for consumer protection under the Provincial People's Committee is responsible for assessing the dossier within 30 days from the receipt of a complete and valid dossier as stipulated at Article 9 Decree 55/2024/ND-CP and may extend the duration for an additional maximum of 30 days in complicated cases. In case of extension, the Provincial People's Committee (the state management agency for consumer protection) shall promptly inform the organization or business individual about the time and reason for the extension.

During the assessment process of the registration dossier, the Provincial People's Committee (the state management agency for consumer protection) has the right to request the organization or business individual to explain necessary issues related to the registration content.

If the organization's or business individual's dossier complies entirely with the provisions of Article 11 of Decree 55/2024/ND-CP, the state management agency for consumer protection under the Provincial People's Committee shall issue a notification of completion of the standard contract registration and general transaction conditions according to Form No. 04 in the Appendix issued with Decree 55/2024/ND-CP. If the organization's or business individual's dossier does not fully comply with the provisions of Article 11 of Decree 55/2024/ND-CP, the state management agency for consumer protection under the Provincial People's Committee shall notify in writing the assessment results of the dossier and specify the reason why the dossier has not yet completed registration, according to Form No. 05 in the Appendix issued with Decree 55/2024/ND-CP;

After completing the registration procedures, information about the organization, business individual, and the registered standard form contracts and general trading conditions will be publicly announced and stored on the electronic portal of the state management agency for consumer protection under the Provincial People's Committee. Organizations and business individuals are responsible for publicly announcing the completed registration notification and the registered standard form contracts and general trading conditions by posting them at a visible location at the office, business location, and on the electronic portal, and application software (if available) throughout the entire period of applying the registered standard form contracts and general trading conditions.

- Application for registration of standard contracts and general transaction conditions according to Form No. 02 in the Appendix issued with Decree 55/2024/ND-CP;

- Draft of the standard form contracts and general trading conditions in Vietnamese.
