Article 9 of Decree 106/2020/ND-CP stipulates the procedures for approving the annual number of employees working at public service providers in Vietnam as follows:
- Public service units, that guarantee recurrent and investment expenditures themselves, and public service providers that guarantee recurrent expenditures themselves shall, based on Clause 2 Article 4 of Decree 106/2020/ND-CP and the guidelines of the competent authorities on staffing norms in public service providers by sector and field, prepare annual staffing plans; organize the appraisal and submit them to the head of the public service provider for approval. In cases where the public service provider has a Management Board, the head of the public service provider must submit the plan to the Management Board for approval before deciding on the staffing of the unit.
- Public service units partially covering their own recurrent expenditures and public service providers funded by state budgets for recurrent expenditures
+ Based on Clause 2 Article 4 of Decree 106/2020/ND-CP and the guidelines of the competent authorities on staffing norms in public service providers by sector and field, public service providers prepare annual staffing plans funded by the state budget for their unit, report to the directly managing superior agency to report to the agencies and organizations as prescribed at Point b Clause 2 Article 9 of Decree 106/2020/ND-CP. For public service providers partially covering their own recurrent expenditures, the staffing plan includes: the number of staff paid from the state budget and the number of staff paid from their own revenue.
- The agencies and organizations tasked with personnel organization of ministries, central authorities, and local authorities receive the dossiers, organize the appraisal of the staffing numbers for public service providers, consolidate the staffing numbers of public service providers partially covering their own recurrent expenditures and public service providers funded by the state budget for recurrent expenditures of ministries, central authorities, and local authorities to submit to the heads of ministries, central authorities, and local authorities for submission to the Ministry of Home Affairs for appraisal.
- The Ministry of Home Affairs appraises the staffing plans funded by the state budget in public service providers partially covering their own recurrent expenditures and public service providers funded by the state budget for recurrent expenditures of ministries, central authorities, and local authorities.
- The ministers, heads of ministry-level agencies, heads of agencies under the Government of Vietnam, heads of organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, the Director of Hanoi National University, and the Director of Ho Chi Minh City National University decide the staffing numbers funded by the state budget for each public service provider partially covering their own recurrent expenditures and public service providers funded by the state budget for recurrent expenditures within their management scope; decide the staffing numbers paid from their own revenue for public service providers partially covering their own recurrent expenditures within their management scope.
- The provincial People's Committees submit the staffing numbers funded by the state budget in public service providers partially covering their own recurrent expenditures and public service providers funded by the state budget for recurrent expenditures to the same level People's Councils for approval within the total staffing numbers appraised by the Ministry of Home Affairs; decide on the staffing numbers funded by the state budget for each public service provider within the management scope within the total staffing numbers approved by the People's Councils; decide on the staffing numbers paid from their own revenue for public service providers partially covering their own recurrent expenditures within the management scope.
Clause 1 Article 11 of Decree 106/2020/ND-CP stipulates that the adjustment of annual number of employees working at public service providers in Vietnam in 2024 is carried out in the following cases:
- Public service units experience changes in one of the bases stipulated in Clause 2 Article 4 of Decree 106/2020/ND-CP, including:
+ Job positions and the actual workload at each job position of the public service provider;
+ The level of office modernization, equipment, working facilities, and IT application;
+ The current management and use of assigned staffing numbers of the unit.
- Public service units are established or reorganized as per decisions of competent authorities.
