The regulations on sessions of the Standing Committee of the People's Council according to Article 106 of the Law on Local Government Organization 2015 are as follows:
Sessions of the Standing Committee of the People's Council are the primary form of activity of the Standing Committee of the People's Council. In these sessions, the Standing Committee discusses and decides on issues within its duties and powers as prescribed by law.
The Standing Committee of the People's Council meets on a regular monthly basis. When necessary, the Standing Committee may hold extraordinary sessions at the request of the Chairman of the People's Council. Each session must have at least two-thirds of the total members of the Standing Committee in attendance.
The Chairman of the People's Council decides the time, and program, directs the preparation, and chairs the session of the Standing Committee. If the Chairman is absent, a Vice-Chairman, authorized by the Chairman, will chair the session.
Members of the Standing Committee of the People's Council are responsible for attending all sessions. If unable to attend due to special reasons, members must report to the Chairman for review and decision.
Representatives of the People's Committee and the Vietnam Fatherland Front Committee at the same level are invited to attend the sessions of the Standing Committee. The Head and Deputy Head of the National Assembly delegation at the provincial level are also invited.
Representatives of the People's Court, the People's Procuracy, heads of specialized agencies under the People's Committee, representatives of socio-political organizations at the same level, and related agencies and organizations may be invited to attend the sessions when discussing related issues.
The People's Committee, People's Court, People's Procuracy, committees of the People's Council, heads of specialized agencies under the People's Committee, and related agencies and organizations are responsible for preparing the projects, proposals, and reports as part of the session agenda according to the assignment of the Standing Committee at the same level or as prescribed by law.
The duties and powers of the Standing Committee of the People's Council according to Article 104 of the Law on Local Government Organization 2015 are as follows:
Convene sessions of the People's Council; coordinate with the People's Committee in preparing the sessions of the People's Council.
Supervise and inspect the implementation of resolutions of the People's Council by the People's Committee and other local state bodies.
Oversee the adherence to the 2013 Constitution and laws at the local level.
Direct, coordinate, and oversee the activities of the committees of the People's Council; review the supervisory results of these committees when necessary and report to the People's Council at the nearest session; maintain liaison with council members; compile the questions of council members to report to the People's Council; request explanations from agencies, organizations, and individuals on issues within the duties and powers of the Standing Committee at its session.
Organize for council members to receive public feedback according to the law; supervise and inspect the resolution of public petitions, complaints, and denunciations; compile the opinions and aspirations of the people to report at the People's Council sessions.
Approve the list of members of the committees of the People's Council from among the council members and approve their resignation upon the proposal of the committee heads.
Present the People's Council assents or votes of non-confidence against individuals elected by the People's Council as prescribed in Articles 88 and 89 of the Law on Local Government Organization 2015.
Decide on referring the dismissal of council members to the People's Council or the electorate.
Report on the activities of the People's Council at the same level to the superior People's Council and People's Committee; the provincial-level Standing Committee reports to the National Assembly and the Government.
Maintain liaison and coordination with the Standing Board of the Vietnam Fatherland Front Committee at the same level; biannually inform the committee about the activities of the People's Council.
