From January 01, 2020, officials are classified and evaluated according to new regulations

This is one of the important provisions stipulated in the Draft Law amending and supplementing a number of articles of the Law on Officials and the Law on Public Employees, expected to take effect from January 1, 2020.

To be specific:, according to the provisions in Clause 3 Article 1 of the Draft amending Article 29 of the Law on Officials 2008, based on the evaluation results, officials are classified for assessment as follows:

a) Excellent completion of duties;

b) Good completion of duties;

c) Completion of duties;

d) Non-completion of duties.

Thus, compared to the current provisions in the Law on Officials 2008, the Draft has omitted the phrase “but still limited in capacity” from the classification result of Completion of duties for officials.

Similarly, Clause 11 Article 1 of the Draft amending and supplementing Article 58 of the Law on Officials 2008 has also omitted the phrase “but still limited in capacity” from the classification result of Completion of duties for officials.

The Draft also emphasizes that officials who do not complete their duties for 02 consecutive years will be subject to the competent authority for dismissal. The Draft has abolished the provision that officials who complete their duties for 02 consecutive years but are still limited in capacity or have 02 consecutive years in which 01 year fulfills duties but is still limited in capacity and 01 year does not fulfill duties will be reassigned by the competent authority.
