Regulations on speakers and information providers when providing information to the press by state administrative agencies in Vietnam according to Article 3 of Decree 09/2017/ND-CP are as follows:
- Individuals responsible for making statements and providing information to the press from ministries, ministry-level agencies, agencies under the Government of Vietnam; general departments under ministries, ministry-level agencies; People's Committees at the provincial level, include:
+ The head of the state administrative agency;
+ The person assigned by the head of the state administrative agency to regularly make statements and provide information to the press (hereinafter referred to as the spokesperson);
+ The individual responsible within the state administrative agency whom the head authorizes to make statements (hereinafter referred to as the person authorized to make statements) or assigns to coordinate with the spokesperson in making statements or providing information to the press on specific issues assigned.
- Individuals responsible for making statements and providing information to the press from departments, specialized agencies under the People's Committees at the provincial level, and provincial organizations structured through vertical management placed locally, include:
+ The head of the state administrative agency;
+ In cases where the head of the state administrative agency is unable to make statements and provide information to the press, they authorize a deputy responsible for the agency to perform these duties.
- Individuals responsible for making statements and providing information to the press from People's Committees at the district and commune levels, include:
+ Chairpersons of People's Committees at the district and commune levels;
+ In cases where the Chairperson of the People's Committee is unable to make statements and provide information to the press, they authorize their deputy to perform these duties.
- The full name, position, phone number, and email address of the spokesperson must be announced to the state management agency on press affairs in writing and must be posted online on the electronic portal or website of the state administrative agency.
- If the spokesperson specified at point b, clause 1, Article 3 of Decree 09/2017/ND-CP is unable to make statements and provide information to the press, they must report to allow the head of the administrative agency to authorize another responsible individual within their organization to fulfill this role.
- The delegation for making statements specified in point c, clause 1, point b, clause 2, point b, clause 3, Article 3 of Decree 09/2017/ND-CP is to be executed in writing, applies only to individual cases, and has a determined time frame.
When authorizing, the full name, position, phone number, and email address of the person authorized to make statements, along with the written authorization, must be publicly posted on the electronic portal, website of the state administrative agency, or listed at the headquarters (for People's Committees at the commune level without a website) within 12 hours from signing the authorization document.
- The spokesperson, person authorized to speak as specified at points b, c, clause 1, point b, clause 2, point b, clause 3, Article 3 of Decree 09/2017/ND-CP may not further authorize others.
- Individuals within the state administrative agency who are not tasked with making statements and providing information to the press may provide information to the press according to legal regulations but cannot represent the state administrative agency in making statements or providing information and are held legally accountable for the content provided.
According to Article 4 of Decree 09/2017/ND-CP, the forms of statements and information provision to the press by state administrative agencies in Vietnam include:
- Holding press conferences.
- Posting content of statements and information on official electronic portals, websites, or social media pages of the state administrative agency.
- Directly speaking or giving interviews to journalists, reporters.
- Sending press releases, responses to journalists, reporters via written form or email.
- Providing information through direct exchanges or at press briefing sessions organized by central or local authorities upon request.
- Issuing documents requesting the press agency to post, broadcast feedback, correction, or apology for the information content on the press.
