1. Types of court costs in cases in Vietnam

1.1. Types of court cost in administrative cases in Vietnam

Article 30 of Resolution 326/2016/UBTVQH14 stipulates the types of court cost in administrative cases as follows:

- First-instance administrative court cost.

- Appellate administrative court cost.

- First-instance civil court cost in cases involving claims for damages, including first-instance civil cases that involve or do not involve a monetary value.

- Appellate civil court cost in cases involving appeals against the damage compensations.

1.2. Types of court cost in civil cases in Vietnam

In Article 24 of Resolution 326/2016/UBTVQH14, the types of court cost in civil cases are as follows:

- The types of civil court cost include:

= First-instance civil court costs for criminal cases that involve no monetary value.

= First-instance civil court costs for civil cases that involve a monetary value.

= Appellate civil court costs.

- Civil cases involving no monetary value means cases in which claims of involved parties are not sums of money or cannot be valued in specific sums of money.

- Civil cases involving a monetary value means cases in which claims of involved parties are sums of money or properties which can be valued in sums of money.

1.3. Court costs in criminal cases in Vietnam

Article 21 of Resolution 326/2016/UBTVQH14 stipulates the court costs in criminal cases as follows:

- First-instance criminal court cost.

- Appellate criminal court cost.

- First-instance civil court cost for courts which also handle the civil parts of criminal cases, including the first-instance civil court cost that involves or does not involve a monetary value.

- Appellate civil court cost for the civil parts of criminal cases which have been appealed against.
