1. Authority to permit the extraction and provision of citizens' information in the National Population Database in Vietnam

The authority to permit the exploitation and provision of citizens' information in the National Population Database is specified in Article 9 of Decree 70/2024/ND-CP as follows:

• The head of the identity management agency of the Ministry of Public Security has the authority to permit state agencies, political organizations, socio-political organizations; credit institutions; intermediary payment service providers; telecommunication and mobile service providers; electronic authentication service providers; and trusted service providers to exploit information in the National Population Database nationwide according to the method specified in Clause 5 Article 10 of the Law on Identification 2023.

• The Director of the Provincial Public Security has the authority to exploit information in the National Population Database to provide to state agencies, political organizations, socio-political organizations at the provincial level; notary organizations, bailiff organizations, and other organizations entrusted with performing public services in the managed area when there is a written request for exploitation and provision of information.

• The Head of the District Public Security has the authority to exploit information in the National Population Database to provide to state agencies, political organizations, socio-political organizations at the district and commune levels, and other organizations headquartered in the managed area as specified in Clause 4 Article 8 of Decree 70/2024/ND-CP when there is a written request for exploitation and provision of information.

• The Head of the Commune Public Security has the authority to exploit information in the National Population Database to provide to individuals residing in the managed area as specified in Clauses 3 and 4 Article 8 of Decree 70/2024/ND-CP when there is a written request for exploitation and provision of information.

• Persons with the authority specified in Clauses 1, 2, 3, and 4 Article 9 of Decree 70/2024/ND-CP decide to permit the exploitation and provision of information in the National Population Database to organizations and individuals specified in Clause 8 Article 10 of the Law on Identification 2023 when the individual whose information is being exploited consents.

2. Subjects and methods of extraction of citizens' information in the National Population Database in Vietnam

Subjects and methods of extraction of citizens' information in the National Population Database in Vietnam are specified in Article 8 of Decree 70/2024/ND-CP as follows:

• State agencies, political organizations, and socio-political organizations exploit information in the National Population Database to serve state management tasks according to their assigned functions, tasks, and powers through the methods of exploiting information specified in Clause 5 Article 10 of the Law on Identification 2023.

Information systems providing citizen information need to extract information including full name, date of birth, personal identification number, and the National Population Database provides information consistent with the functions and tasks of the exploiting agencies and organizations.

• Credit institutions, intermediary payment service providers, telecommunications and mobile service providers, electronic authentication service providers, trusted service providers, notary organizations, bailiff organizations, and other organizations entrusted with performing public services exploit citizen information in the National Population Database through the methods of exploiting information specified in points b, c, d, đ and e Clause 5 Article 10 of the Law on Identification 2023.

• Through methods of exploiting information specified in points b, c, d Clause 5 Article 10 of the Law on Identification 2023 and through administrative procedure resolution information systems at the ministerial and provincial levels, citizens exploit their own information in the National Population Database to carry out administrative procedures and serve other activities according to their needs. Citizens provide information including personal identification number, full name, date of birth, and are provided with the necessary information from the National Population Database as required.

• Organizations and individuals not specified in Clauses 1, 2, 3 Article 8 of Decree 70/2024/ND-CP exploit information in the National Population Database through the methods of exploiting information specified in points c, d, đ Clause 5 Article 10 of the Law on Identification 2023.

• Organizations and individuals specified in Clauses 2, 4 Article 8 of Decree 70/2024/ND-CP are allowed to exploit information in the National Population Database when the identity management agency and the individual whose information is to be exploited consent.

• In cases where the legal representative of a person who has lost civil act capacity, a person with difficulty in perception, behavior control, a person under 14 years of age, a person declared missing, or the heir of a deceased person exploits information in the National Population Database, a written request for information provision and documents proving that the person is the legal representative or heir of the citizen must be provided, except where representative or heir information is already available in the National Population Database or other national databases or specialized databases.
