Rights and Responsibilities of the Investor in the Appraisal of Construction Designs

Recently, the Government of Vietnam promulgated Decree 113/2020/ND-CP detailing Point d, Clause 3, Article 3 of the amended Construction Law 2020 on the appraisal process of construction designs implemented after basic design and exemption from construction permits.

Rights and responsibilities of the investor in appraising construction design for construction projects requiring appraisal, adjusting post-basic design implementation are specified as follows:

- The investor is entitled to propose the appraisal of the design to be implemented after the basic design and review, evaluate the conditions for construction permit exemption as regulated in this Decree or separately carry out the procedures for appraising the design to be implemented after the basic design and the procedures for obtaining a construction permit in accordance with the Construction Law 2014 and Decree 59/2015/ND-CP, as amended and supplemented by Decree 42/2017/ND-CP;- The investor is responsible for the legality and accuracy of the files submitted for appraisal and for complying with the requirements of the appraisal authority and the conditions for construction permit issuance.
