In the past week (from August 06, 2018 to August 11, 2018), Thu Ky Luat has updated numerous new documents, notably the following documents:

  1. Content of Pilotage Service Coordination Regulations

According to the regulations in Circular 43/2018/TT-BGTVT, there must be at least 02 pilot organizations operating in a compulsory maritime pilotage area. These organizations must have a Coordination Regulation for providing pilotage services.

The regulation must ensure it includes the following basic contents:

- Contact information of the coordinating pilot organization;- Daily ship guiding plan of the pilot organization;- Coordination among maritime pilots during the ship guiding process;- Notification of ship guiding situations in necessary cases such as accidents, incidents, or detection of dangerous obstacles to maritime activities;- Assignment of maritime pilots to guide ships from docks, buoy berths, ports, anchorages, transshipment areas, storm shelter areas, shipbuilding and repair yards to corresponding places;- Support for facilities and means;- …

Circular 43/2018/TT-BGTVT takes effect from October 1, 2018, replacing Circular 58/2011/TT-BGTVT.

  1. Addition of Several Medical Technical Services from August 8, 2018

On August 8, 2018, the Ministry of Health signed Decision 4883/QD-BYT to add several equivalent medical technical services to implement Interministerial Circular 37/2015/TTLT-BYT-BTC that was not included in Decision 4442/QD-BYT dated July 13, 2018. Among them are:

- 02 internal medicine technical services;- 01 oncology technical service;- 02 otorhinolaryngology technical services;- 01 hematology and blood transfusion technical service;- 250 pediatric technical services.

Details can be found in Appendix 1 attached to Decision 4883/QD-BYT.

At the same time, the Ministry of Health cancels 09 inappropriate equivalent codes and corrects spelling errors of some equivalent codes in Appendix 1 issued with Decision 4442/QD-BYT. Details are provided in Appendix 2 attached to Decision 4883/QD-BYT.

  1. Proposing National Assembly to Approve Amended Labor Code in 2019

According to the program under Resolution 549/NQ-UBTVQH14 on drafting laws and ordinances for 2019, amending the 2018 Law and Ordinance drafting program, the amended Labor Code will continue to be presented to the National Assembly at the 7th and 8th sessions.

The proposed timeline for the amended Labor Code is as follows:

- The Standing Committee of the National Assembly (UBTVQH) will give feedback on the project presented to the National Assembly for the first time or approve it following a session’s agenda in March 2019;- UBTVQH will give feedback on explanations and acquisitions before presenting it to the National Assembly for approval in August 2019.

And the nearest event will be at the 6th session (October 2018) where the National Assembly will be presented with draft laws such as:

- Law on Education (amended);- Law amending and supplementing certain articles of the Higher Education Law;- Law on People's Public Security (amended);- Law on Tax Administration (amended);- Law on Coast Guard;- Law on Amnesty (amended)...

  1. Amending Regulations on Appointment of Managerial Positions in Defense Enterprises

Circular 105/2018/TT-BQP amends and supplements Circular 147/2016/TT-BQP regulating the appointment of managers at state-owned enterprises managed by the Ministry of Defense and representatives at joint-stock companies with more than 50% state capital represented by the Ministry of Defense.

This amendment adjusts the regulations on appointing the Chairman of the Members' Council, Company Chairman as follows:

- Must not be currently working at a unit under the Ministry of Defense's budget. If appointing a working official from a unit under the Ministry of Defense's budget, there must be a transfer or deployment decision;- Must not concurrently hold the positions of General Director, Director, or controller in their corporation, company, and other enterprises unless otherwise stipulated;- Must not concurrently hold managerial and executive positions in subsidiaries within a corporation or company.

Circular 105/2018/TT-BQP takes effect from September 8, 2018.
