Organizational structure of Departments and criteria for establishing subordinate organizations under the departments in Vietnam

- The organizational structure of the department includes:

+ Specialized and operational divisions;

+ Inspectorate (if any);

+ Office (if any);

+ Sub-departments and equivalent organizations (if any);

+ Public non-business units (if any).

- Criteria for establishing specialized and operational divisions under the department

+ Having the function and task of advising on state management towards sectors and fields under the department's function and tasks;

+ The workload requires allocating a minimum of 07 official staff for divisions under departments in Hanoi and Ho Chi Minh City; a minimum of 06 official staff for divisions under departments of provincial level type I; a minimum of 05 official staff for divisions under departments of provincial level type II and type III.

- Criteria for establishing an Office under the department are applied according to the regulations at point b, clause 2 of this Article. In case an Office under the department is not established, assign a specialized division to perform the functions and tasks of the Office.

- Criteria for establishing sub-departments and equivalent organizations under the department (hereinafter collectively referred to as sub-departments)

+ Having objects of management in specialized sectors and fields under the department's function and tasks according to specialized legal regulations;

+ Being authorized to decide on matters within the scope of state management of specialized sectors and fields;

+ The workload requires allocating a minimum of 12 official staff.

- Criteria for establishing divisions and equivalents under sub-departments of the department (hereinafter collectively referred to as divisions under sub-departments)

+ Having the function and task of advising on state management towards sectors and fields under the sub-department's function and tasks or advising on the sub-department's internal administrative work;

+ The workload requires allocating a minimum of 05 official staff.
