Vietnam: A conference, seminar or meeting containing state secret contents shall use corded microphones

This is a new notable content of Decree No. 26/2020/ND-CP of Vietnam’s Government elaborating some articles of the State Secrets Protection Law.

According to Point a Clause 2 Article 6 of Decree No. 26/2020/ND-CP of Vietnam’s Government, a conference, seminar or meeting containing state secret contents shall use corded microphones and equipment and devices that have undergone security and safety inspection by the Ministry of Public Security/provincial police force before installation.

Thus, from July 01, 2020, only corded microphones and devices that have been inspected by the Ministry of Public Security or provincial police are allowed to be used in cases where conferences or seminars involve state secrets.

This is a completely new regulation of Decree No. 26/2020/ND-CP. Currently, the Ordinance on State Secrets Protection 2000 and Decree No. 33/2002/ND-CP do not mention this issue.

However, the above regulation does not apply to all cases. Specifically, if the equipment is provided by the Government Security Committee or if the conference, seminar, or meeting is organized and led by the Ministry of Defense or the Government Security Committee, there is no need for inspection.

Moreover, Decree No. 26/2020/ND-CP also stipulates that online conferences, seminars and meetings containing state secret contents must have their connections protected as per regulations of laws on cryptography.
