Draft Law amending and supplementing a number of articles of the Law on Officials and the Law on Public Employees is expected to take effect from January 1, 2020. Notably, the content stipulates forms of disciplinary action against officials who have retired or resigned but were later found to have committed violations.

To be specific, according to Clause 16, Article 1 of the Draft amending and supplementing Article 84 of the Law on Officials 2008, officials and public employees who are found to have violated regulations during their tenure after they have resigned or retired shall be subject to one of the following disciplinary actions, depending on the nature and severity of the violation:
1. Reprimand.
2. Warning.
3. Revocation of the title held at the time of the violation.
Thus, if this content in the Draft is approved, from January 1, 2020, officials and public employees who violated regulations previously will still be disciplined in one of the three aforementioned forms, even if they have retired or resigned.
Additionally, according to the Draft, from January 1, 2020, the disciplinary form of demotion will no longer be applied to officials in order to tighten disciplinary regulations for violating officials.
