Vietnam: Highlighted legislative documents of the week (July 4-9)

From July 04 - 09, 2016, There are numerous important legislative documents in various fields such as labor, business, construction... Notable examples include:

  1. Simplification of Construction Permits for Detached Houses in Vietnam

This content is specified in Circular 15/2016/TT-BXD guiding the issuance of construction permits, effective from August 15, 2016. Accordingly:

There will no longer be separate application dossiers for urban and rural detached houses, but instead, a single general dossier which includes:

- An application form for the construction permit;- Copies or files containing scanned papers proving land use rights, two sets of technical design drawings or approved construction drawing designs…- A written commitment from the investor ensuring the safety of adjacent works in case the construction has adjoining structures.

  1. Allowance for Officials Subject to Downsizing in Vietnam

According to Official Dispatch 3036/TCT-TVQT dated July 7, 2016, which adjusts the funding for the implementation of the downsizing policy in cases where the postponement of downsizing implementation timing is approved according to the actual break time.

Simultaneously, the dispatch also stipulates allowances for officials in cases where the approved downsizing timing remains unchanged but the unit has already paid salary and other allowances to the official during the gap period between the approved downsizing timing and the actual leave time.

  1. Guidance on Placing Buy and Sell Orders for the Same Security

According to Official Dispatch 4397/UBCK-PTTT dated July 7, 2016, addressing issues related to the operations of securities companies, investors are allowed to place both buy and sell orders simultaneously for the same type of securities (CK) during the trading session as follows:

- Investors can place simultaneous buy and sell orders for the same type of CK in the same continuous matching session when they have sufficient funds/securities to perform the transaction according to conformable.- In cases where the investor has already placed buy or sell orders in the previous continuous matching session but the orders have not been matched and are still valid, the investor can continue to place buy or sell orders for the same type of CK when moving to the periodic matching session.

  1. Strict Safety Requirements for 17 Job Groups

Circular 13/2016/TT-BLDTBXH issuing the list of jobs with strict safety and hygiene requirements, effective from August 1, 2016, stipulates as follows:

A list of 17 groups of jobs requiring strict safety and hygiene standards replaces the 13 job groups in the appendix of Circular 27/2013/TT-BLDTBXH.

  1. Guidance on Implementing Occupational Safety and Hygiene Policies in Vietnam

This content is mentioned in Official Dispatch 2533/LDTBXH-ATLD providing temporary guidance on implementing occupational safety and occupational disease policies according to the Law on Occupational Safety and Hygiene.

occupational safety and occupational diseases policies apply to individuals receiving occupational accident and occupational disease benefits, and individuals who have been treated and discharged before July 1, 2016, as follows:

- Conditions, benefit levels, dossiers, and procedures for receiving occupational safety and occupational diseases policies are implemented according to the provisions of the Law on Social Insurance 2014 and guiding documents for implementing occupational safety and occupational disease policies issued before July 1, 2016;

- Payment for assessment fees to evaluate the reduction of working capacity due to occupational safety and occupational diseases in cases specified in point b, clause 1, article 45 of the Law on Social Insurance 2014, if the conclusion by the Medical Assessment Council from January 1, 2016, to before July 1, 2016, confirms the reduction of working capacity level sufficient for benefits.
