Issuance of the Decree guiding the Housing Law 2023 on the development and management of social housing in Vietnam

Decree 100/2024/ND-CP specifies certain articles, clauses, and points stipulated in the Housing Law 2023 concerning:

- Clause 2, Article 83 on the regulations requiring commercial housing project investors to allocate a portion of homestead land area within the project where they have invested in technical infrastructure systems for the construction of social housing or allocate a social housing land fund with invested technical infrastructure systems in another location outside the commercial housing project in that urban area, or alternatively, pay an amount equivalent to the value of the land fund invested in technical infrastructure systems for the construction of social housing.

- Clause 2, Article 34 on the stages of social housing investment construction projects, housing for the armed forces.

- Points a, b, Clause 4, Article 84 on selecting investors for social housing investment construction projects.

- Points c, d, e, Clause 2, Article 85 and Clause 3, Article 85 on incentives for investors in social housing construction projects (standard profit margins; service, commercial, and commercial housing business area; preferential loans), and investors of commercial housing construction projects directly investing in social housing within the commercial housing projects.

- Article 82 on the types and standards of social housing area.

- Points a, b, Clause 1; Clause 6 and Clause 8, Article 78 on conditions for enjoying social housing support policies.

- Clause 6, Article 87 on determining the selling price, hire-purchase price, and rental price of social housing not built using public investment or trade union financial resources.

- Clause 4, Article 126 on determining the price of social housing, housing for the armed forces within public assets; exemptions and reductions in rent for social housing, housing for the armed forces; management, use, and operation of social housing, housing for the armed forces within public assets.

- Clause 9, Article 88, and point e, Clause 1, Article 89 on land levy payment when reselling social housing.

- Clause 4, Article 89 on the process and procedures for selling, hire-purchasing, and renting social housing.

- Clause 2, Article 94 on ensuring environmental safety conditions, scale, and percentage of land area for developing worker accommodation within industrial zones.

- Clause 4, Article 100 on the rental, management, and use of worker accommodation within industrial zones.

- Clause 3, Article 109 on the process and procedures for selling, hire-purchasing, and renting housing for the armed forces.

- Clause 5, Article 77 on support for preferential loans from the State through the Social Policy Bank, credit institutions designated by the State to purchase, hire-purchase social housing, housing for the armed forces, or self-build, renovate, or repair housing.

- Clause 4, Article 117 on preferential loans through the Social Policy Bank, the Vietnam Development Bank for social housing development.

- Clause 2, Article 125 on appraising schemes for selling social housing, housing for the armed forces within public assets currently for rent.

- Clause 10, Article 88 on enforcing the recovery of social housing.

- Clause 2, Article 191 on transitional provisions regarding social housing.

More details can be found in Decree 100/2024/ND-CP which comes into force in Vietnam from August 1, 2024.
