Cases for reissuing Land use right certificates in Vietnam from August 1, 2024

On July 29, 2024, the Government of Vietnam issued Decree 101/2024/ND-CP providing regulations on basic land investigation; registration, issuance of Certificates of Land Use Rights, ownership of assets attached to land, and the Land Information System.

Cases for reissuing Land use right certificates in Vietnam from August 1, 2024

The cases for reissuing Land use right certificates in Vietnam from August 1, 2024, include:

- Land users who need to exchange Certificates issued before August 1, 2024, to Certificates of land use rights, ownership of assets attached to the land;

- The issued Certificate is torn, blurred, or damaged;

- The issued Certificate is common to multiple parcels but needs to be individually issued for each parcel based on the land user's needs, and the case of reissuing the Certificate of land use rights, ownership of assets attached to the land as stipulated in Clause 7, Article 46 of Decree 101/2024/ND-CP;

- The land use purpose recorded on the issued Certificate according to the land law regulations at the time of issuance differs from the land use purpose classification stipulated in Article 9 of the Land Law 2024 and the regulations stipulated in the Decree of the Government of Vietnam detailing the implementation of some articles of the Land Law 2024;

- The location of the parcel on the issued Certificate is inaccurate compared to the actual land use location at the time of issuance;

- Land use rights, ownership of assets attached to the land are common assets of husband and wife, but the issued Certificate only records the name of either the husband or the wife. Now, there is a request to reissue the Certificate of land use rights, ownership of assets attached to the land to include both the husband's and wife's names;

- The issued Certificate records the household name, now the household members with common land use rights request to reissue the Certificate of land use rights, ownership of assets attached to the land to record all members with common land use rights of the household;

- Change in the address of the parcel that has been issued the Certificate;

- Change in the dimensions, area, and identification number of the parcel due to cadastral mapping or specific cadastral measurements where the boundaries of the parcel remain unchanged.

More details can be found in Decree 101/2024/ND-CP which comes into force in Vietnam from August 1, 2024.
