Vietnam: Severe fines for making or receiving orders for processing of prohibited goods

This is a notable content of the Decree No. 98/2020/NĐ-CP of Vietnam’s Government prescribing penalties for administrative violations against regulations on commerce, production and trade in counterfeit and prohibited goods, and protection of consumer rights, issued on August 26, 2020.

According to Article 76 of Decree No. 98/2020/NĐ-CP of Vietnam’s Government, administrative penalties for violations against regulations on processing of goods in commerce are specified as follows:

- A fine ranging from VND 500.000 to VND 1.000.000 shall be imposed for making or receiving orders for processing of goods without entering into processing contracts as prescribed.

- A fine ranging from VND 10.000.000 to VND 30.000.000 shall be imposed for making or receiving orders for processing of prohibited goods or domestically sold goods against which the emergency measure that is prohibition or suspension of sale of goods is implemented. Moreover, the exhibits of this violation shall be confiscated.

Besides, the violating entity is compelled to return any benefits illegally obtained from the commission of the violation mentioned above.
