Targets for Legal Aid Assistants' Involvement in Litigation Cases in 2018 in Vietnam

According to Official Dispatch 104/BTP-TGPL dated January 10, 2018, of the Ministry of Justice of Vietnam, in 2018, legal aid assistants must ensure participation in at least four new cases to meet the target, thereby serving as a basis for evaluating the level of task completion and consideration for emulation and commendation in 2018.

02 cases for exemption or reduction of targets

Case 1:

- Director of the State Legal Aid Center (or Acting Director, Deputy Director in charge of the State Legal Aid Center): Achieve at least 30% of the targets mentioned above;

- Deputy Director of the State Legal Aid Center: Achieve at least 60% of the targets mentioned above.

Case 2:

- Legal aid assistants who are sent for training; on sick leave, maternity leave; secondment; or in cases of leave or absence with other legitimate reasons that make it impossible to participate in legal proceedings, will be exempted or have the targets reduced corresponding to the duration of absence at the State Legal Aid Center.

- For legal aid assistants appointed for less than 1 year; legal aid assistants transitioning between two target levels due to a change in the number of appointment years, the target will be calculated corresponding to the period they have been appointed.

Example 1: A legal aid assistant newly appointed for 8 months. The target is calculated as follows: 4 cases x 8 months / 12 months = 2.67 cases, rounded to 3 cases. Thus, this legal aid assistant must handle at least 3 cases.

Example 2: In the first 3 months of the year, a legal aid assistant appointed for less than 3 years has a target of at least 4 cases; for the remaining 9 months of the year, a legal aid assistant appointed from 3 to less than 5 years has a target of at least 8 cases. The target is calculated as follows:

+ First 3 months of the year: 4 cases x 3 months / 12 months = 1 case.

+ Remaining 9 months of the year: 8 cases x 9 months / 12 months = 6 cases.

>> Therefore, within the year, this legal aid assistant must handle at least 7 cases.

Example 3: A female legal aid assistant appointed for less than 3 years who gives birth and takes maternity leave before and after childbirth for 6 months will have the target calculated corresponding to the working time at the State Legal Aid Center. Thus, the target is reduced from at least 4 litigation cases/year to at least 2 litigation cases/year (formula: 4 cases x 6 months / 12 months = 2 cases).

Rounding principles for calculating cases

If the decimal value after the integer is less than 5, the number of cases is rounded down to the integer; if the decimal value is 5 or greater, the integer increases by 1 unit.
