On February 15, 2023, the Government issued Decree 05/2023/ND-CP amending Decree 56/2011/ND-CP on preferential allowances according to occupations for civil servants and public employees working at public health facilities.

1. Increase in occupational incentive allowances for preventive medicine and grassroots health workers in Vietnam

Article 1 of Decree 05/2023/ND-CP has added Clause 7 Article 3 of Decree 56/2011/ND-CP as follows:

Job-based preferential allowances for preventive healthcare and grassroots health workers apply from January 1, 2022 to the end of December 31, 2023:

- The allowance rate of 100% applies to public employees who regularly and directly work in preventive medicine (including border medical quarantine); do medical professionals at health stations of communes, wards and townships, regional polyclinics, maternity wards, medical centers of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities and hospitals of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities.

- During the period of application of job-based preferential allowance for preventive medicine and grassroots health workers specified in Clause 7 of this Article, Point c, Clause 2 Article 3 of Decree 56/2011/ND-CP and regulations for public employees who regularly and directly work in preventive medicine specified in Clause 4, Article 3 of Decree 56/2011/ND-CP.

Thus, the occupational incentive allowance for preventive medicine and grassroots health workers increases to 100%.

2. Funding sources of occupational incentive allowances for health civil servants and public employees in Vietnam

Funding sources for the implementation of the vocational preferential allowance regime for health civil servants and public employees shall be guaranteed by the state budget according to the current budget decentralization, revenues of medical facilities from non-business activities of the unit as prescribed.

Particularly in 2011, the additional funding to implement the allowance regime specified in Circular 02/2012/TTLT-BYT-BNV-BTC shall be handled as follows:

- For the provinces and centrally-run cities, it is aggregated into the demand for salary reform and handled from the salary reform source as prescribed; As follows:

+ Public non-business medical establishments that directly pay salaries to civil servants and public employees are responsible for making reports on the need for funding to pay additional preferential allowances by occupation in 2011, according to Table 1 promulgated together with Circular 02/2012/TTLT-BYT-BNV-BTC and sent to the immediate superior management agency according to the current budget decentralization (hereinafter referred to as the immediate superior management agency).

+ The superior management agency directly appraises and summarizes the need for additional funding of public non-business facilities under its management according to Table 2 promulgated together with Circular 02/2012/TTLT-BYT-BNV-BTC to the Finance Authority at the same level.

+ The financial agency is responsible for appraising and synthesizing additional funding needs according to Tables 2, 3 promulgated together with Circular 02/2012/TTLT-BYT-BNV-BTC and submitted to the People's Committees of the provinces and centrally-run cities for decision.

+ The People's Committees of the provinces and centrally-run cities shall summarize and make a report according to Table 3 and send it to the Ministry of Finance for consideration and settlement according to regulations.

- For ministries, ministerial-level agencies, and government-attached agencies:

+ Public health service establishments that directly pay salaries to civil servants and public employees are responsible for making reports on demand and sources of payment of additional preferential allowances according to occupations in 2011 according to Tables 4 and 5, promulgated together with this Joint Circular and sent to the immediate superior management agency according to the current budget decentralization.

+ The superior management agency directly appraises and summarizes the needs and sources of funds for payment of additional preferential allowances according to Tables 6 and 7 promulgated together with Circular 02/2012/TTLT-BYT-BNV-BTC sent to superior management agencies by ministries, ministerial-level agencies, and government-attached agencies.

+ Ministries, ministerial-level agencies, and government-attached agencies are responsible for appraising, synthesizing, and making reports according to Tables 6 and 7 promulgated together with Circular 02/2012/TTLT-BYT-BNV-BTC sent to the Ministry of Finance for consideration and settlement according to regulations.
