Guidelines on the Documentation for Handling Policies for War Invalids Concurrently Recognized as Sick Soldiers

On May 15, 2013, Circular 05/2013/TT-BLDTBXH was issued by the Ministry of Labor, Invalids and Social Affairs, providing guidance on the procedures for preparing dossiers, managing dossiers, and implementing preferential policies for people with meritorious services to the revolution and their relatives.

According to the provisions of Article 22 of Circular 05/2013/TT-BLDTBXH, the dossier for resolving policies for war invalids who are also diseased veterans includes an Application Form (Form TB6) and dossiers for diseased veterans and war invalids.

Also according to Circular 05, the procedures for resolving policies for war invalids who are also diseased veterans are implemented as follows:

- The individual submits the application form to the Department of Labor, War Invalids, and Social Affairs where they reside;- The Department of Labor, War Invalids, and Social Affairs, within 15 days from the date of receiving the application, is responsible for verifying the managed dossier to issue the decision for disability allowance or diseased veteran allowance and sends an excerpt of the dossier to the Ministry of Labor, War Invalids, and Social Affairs (Department of Persons with Meritorious Services).

It should be noted that in cases where war invalids are also diseased veterans confirmed prior to December 31, 1994, and re-evaluated for disability from January 1, 1995, to the effective date of Circular 05/2013/TT-BLDTBXH (July 1, 2019), the final disability assessment report is used as the basis for policy entitlements.

Refer to other provisions in Circular 05/2013/TT-BLDTBXH, which takes effect from July 1, 2013.
