From August 1, 2024, only people with income under 15 million VND will be eligible to purchase social housing in Vietnam

On July 26, 2024, the Government of Vietnam issued Decree 100/2024/ND-CP, detailing certain provisions of the Housing Law 2023 on the development and management of social housing in Vietnam.

From August 1, 2024, only people with income under 15 million VND will be eligible to purchase social housing in Vietnam

Article 30 of Decree 100/2024/ND-CP stipulates the income conditions to enjoy the policy of purchasing social housing as follows:

- For subjects specified in clauses 5, 6, and 8 of Article 76 of the Housing Law 2023, the income conditions are as follows:

+ In case the applicant is single, the actual monthly income must not exceed 15 million VND, as verified by the wage and salary board of the agency, unit, or enterprise where the applicant works.

+ If the applicant is married according to the law, the combined actual monthly income of the applicant and their spouse must not exceed 30 million VND, as verified by the wage and salary board of the agency, unit, or enterprise where the applicant works.

+ The income condition must be determined within 1 year prior to the time of submitting the application for purchasing or renting social housing.

- For subjects specified in clause 5 of Article 76 of the Housing Law 2023 who do not have a labor contract, if single, the actual monthly income must not exceed 15 million VND; if married according to the law, the combined actual monthly income of the applicant and their spouse must not exceed 30 million VND. Within 7 days from the date of receiving the application for income verification, the commune-level People's Committee will verify the income condition within 1 year prior to the time of submitting the application for purchasing or renting social housing.

- For subjects specified in clauses 2, 3, and 4 of Article 76 of the Housing Law 2023, they must belong to poor or near-poor households according to the poverty standards of the Government of Vietnam.

- For subjects specified in clause 7 of Article 76 of the Housing Law 2023, the income condition will be applied according to Article 67 of Decree 100/2024/ND-CP.

Therefore, according to the above regulations, from August 1, 2024, when Decree 100/2024/ND-CP officially takes effect along with the Housing Law 2023, individuals wishing to purchase social housing must have a monthly income below 15 million VND if they are single.

Eligibility for social housing support policies in Vietnam

- In cases where individuals do not own a house, it will be confirmed if the applicant specified in clause 1 of Article 77 of the Housing Law 2023 and their spouse (if any) do not have their names on the land use right certificate, property ownership attached to land in the province or centrally-run city where the social housing project is located at the time of submitting the application for purchasing or renting social housing.

Within 7 days from the date of receiving the application for confirmation, the district-level Office/Branch of Land Registration of the province or centrally-run city where the social housing project is located will verify the aforementioned conditions.

- In cases where the applicant specified in clause 1 of Article 77 of the Housing Law 2023 owns a house, but the per capita housing area is less than 15 m2 floor/person. The per capita housing area specified in this clause is determined based on including the applicant, their spouse (if any), parents (if any), and children (if any) registered for permanent residence at that house.

Within 7 days from the date of receiving the application for confirmation of per capita housing area, the commune-level People's Committee will verify the aforementioned conditions.
