Destruction of Expired Electronic Invoices

Electronic invoices offer numerous benefits for both businesses and tax agencies: They help businesses quickly conduct transactions, issue various types of invoices, and store them promptly; shortening the time required for declaration and audit procedures.

To apply and manage electronic invoices within the framework, the Government of Vietnam issued Decree 119/2018/ND-CP stipulating electronic invoices when selling goods and providing services. Notably, there are provisions on the preservation, storage, and destruction of electronic invoices.

According to the Decree, electronic invoices are to be preserved and stored by electronic means. Agencies, organizations, and individuals have the right to choose and apply suitable methods for preserving and storing electronic invoices in accordance with their operational characteristics and technological capabilities.

The storage of electronic invoices must ensure:

- Security, confidentiality, integrity, completeness, and immutability during the entire storage period;- Storage for the correct and sufficient period as prescribed by accounting law;- The ability to be printed out or retrieved upon request.

According to regulations, electronic invoices that have expired their storage period as prescribed by accounting law, if not otherwise regulated, shall be destroyed.

Additionally, the destruction of electronic invoices must not affect the integrity of the data messages of invoices that have not been destroyed and the normal operation of the information system.

Decree 119/2018/ND-CP takes effect from November 1, 2018, replacing Decree 04/2014/ND-CP.
